Timeline

Need help here. Do I have to do any other form before he enters the US? My fiance has already a job lined up and would like to start work ASAP after entering the US. first of all I know he needs a social security number. How soon after his entry can he apply and also is it wise to apply for I-765 to get his work permit in the mean time while he applies for his adjustment of status. I have no clue as to what is best to do after he enters the US. Also can he apply for a drivers license. Any advice would be greatly appreciated.

Timeline

Marriage would be ASAP, but get the SSN beforehand.

Then AOS which includes getting the work permit.

Local DMV web site will show what he needs to get a DL, in my State it was EAD.

Get social security number and then marry.

Apply I-485, I-765 and I-131. Note that he cant work until he gets EAD card which could take up to 90 days from the date of filling.

My wife can get her ID with SSN card, I-94, I-485 NOA-1, passport , and 2 proofs of resident. ( without EAD card ). Her ID will be expired in 4 years. I am not sure about DL but you can stop by to ask them because the requirements do not give you a clear answer for K-1 on Florida DMV website.

New Journey AOS:

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

No, he does not need any form to enter the US. Though some people said you can apply SSN after got married but some others got refused. I think he will be okay since he likely won't change his last name, isn't he?

Also you can apply now SSN anytime until 3 weeks before I-94 is about to expired. You need to apply I-765 concurred with I-485 and usually an EAD got approval approximately 2 or 3 months after filed. And he can legally started working.

No, he can't work until he gets approval of his EAD. Filed does not mean you can legally work or get authorization to work.

Technically, he can apply after he arrives but the EAD will expire in the same day with I-94. Note that his I-94 will expire in 90 days and it might take up 90 days to have EAD. He might get an expriration EAD when it arrives. For example, he will arrive to US tomorrow, so his I-94 will expire around 10/7. He will apply EAD right away and get his EAD around 9/7 -10/7. If he receives his EAD on 10/7, his EAD already expires because it expires on the same day as I-94. If he submits before AOS, then he has to pay 340 dollar.

It would recommend to fill EAD with I-485 together so he does not have to pay EAD fee and it will expire in 1 year.

You can get one by online. You have submitted I-94 ( printed) along with all documents for I-485 ( adjust of status), I-765( permission to work), or if you wanted to apply advance of parole ( I-131).

It will take from 1-14 days to have his info on the system after he arrives. I would try to enter his info into the website above after he arrives 2 days and hopefully he can print out his I-94.

If he already has a job offer, he possibly can have his EAD expedited and recieve it much faster. I dont know for sure, but its worth looking into.
