I was hoping someone could help me or at least give me an idea.

I want to petition for a K1 visa, but we have heard that we cannot do that if she already has an L1 visa. Her L1 visa expires March 2015 and her current work project has her living in her home country of China.

Can i petition for K1 if she already has L1 that is good? I am planning my proposal when i fly in October and will petition once i return. I wanted to know what all i must have to do to make it more seamless for her.

Would i be able to petition for K1 while it is still good? Is there another set of procedures i must follow, if so what are they? Will this cause the process to take more time?

Any help would be greatly appreciated. I do not want her to worry and would like to have a good plan for her coming here.
