K2 Illegitimate Child

Hey guys!! I'm in need of someone who's been through this before. A little background: I have a 2y/o daughter that'll be under a k2 visa. I wasn't married to her biological dad but she uses his last name which he signed on her BC when we had it registered. We broke up af few months after giving birth and he never gave support on anything simce the beginning. I kinda have lots of questions and I hope someone can clarify things for me. I'm from the Philippines and I look forward to someone helping me out on some country specific process on this.

1. What if her dad won't sign any consent that he allows her to leave the country? Will I be needing that? Will that be asked at the interview or immigration? Her dad never supported her on anything since she was born and now he wouldn't even sign any papers. I'm so devastated!!

2. Does she need to have a medical exam and attend the interview with me?

3. The thing is, she'll be following to join after 2months and she'll be traveling with my mom to attend my wedding which will also buy me some time to adjust there. I just want all the paperworks to be over with so they don't have to do anything else after I leave. What do I need to do? What's the process for her?

The thing that worries me the most is the consent from her dad. I know I have full custody as long as I can prove that we were never married. I'm just worried about the papers we'll be needing from him or if there will be any. Hope anyone can give some insights. All help is greatly appreciated. Thanks!!

1) You, the mother, has sole custody of the child, you do NOT need any signed consent from the father. Relax all is fine.

2) Yes the child has to complete the same process as you, only a few of the document requirements from the embassy instructions letter are different for the K2.

3) Does your mom already have her visa? If not don't count on this happening. If your mom has a visa and is good to travel then your mom will need a consent letter from you for traveling with the child.

The father is a "non-factor" so forget about him.
