No "promises" will throw her over the border. Her GC is approved and stamp is in her passport. She won't fall for any promise made with or without Op's attorney. She'll be in the US for as long as she's legal, and she'll look for ways to remain legal. Her husband is not the only person on the ground with ability to secure legal assistance

I did burn the bridge with my big mouth when I told her I would divorce her if she went back home last week.This week she is only willing to leave with a divorce decree in hand. I have no desire to have her here for up to a year. Like a tree, the longer she stays the greater her roots here will be and the harder it will be to get her out of here.

If question was addressed to me: I'd lived in my future wife's country for years before she called me thru an acquaintance. We did have (safe) sex on first date, and we lived together over a year before she ever entered the US, and for two years thereafter. But it got to be rough eventually: just like OP's wife, mine turned out to have incurable psychological disorders. So deep, that she didn't care less about own children: not at a few days, not at a few years, not ever. Now, that was deep - and I had no previous experience. First and last marriage, unfortunately. Here, OP says he had first hand experience with a very similar to his lady's issue - yet, he married and sponsored his new wife to the US. My heart goes out to him: what does he do now?

Unfortunately that evil witch still wins. With the stamp in her passport, she's good for at least 2 years. When it's time for the 10 year green card, and she can't prove her marriage was in good faith, with our jacked up immigration system she can still "disappear" and remain illegally. I wouldn't be surprised if she turned up married to some other poor sucker . . .

promise her that you will pay for her upkeep and whatever she needs when she gets back home and that you gonna support her in whatever way she may need,but ones she's gone,cut off all communication with her and don't support her at all..........

You guys do realize that she can come back to the US whenever she wants, right?

No she doesn't. She has a green card. She actually has a right to stay.

However, he can get divorced. He can protect himself from false VAWA claims as well. Upon divorce she must file for the ROC. She will likely not be able to prove a genuine marriage (rather hard to do in a such a short period) and be denied the 10 year green card. At that point she will have to go back to her home country. Let the system work, it does have a plan.

But she can't be successful filing for ROC if she cannot prove a bona fide marriage (which it certainly isn't), right? He certainly isn't going to want to help her file ROC, so wouldn't she have no alternative but to return .....ah I see. LOL...you're saying the same thing. Pardon!

Wrong. Divorce waiver with ROC. Only rule is to ENTER marriage in good faith.

It's really not the numbers, as it is agendas. And now she's in perfect position to call a very high price. The harder OP pushes via attorney, the higher her price may be. No?

Sorry Singledad, but my comment still applies even If he has 38, the age gap its big and still ahuge red flag for visa fraud and more when its about a higher visa fraud country.

Wish I had the ability to express this without having my post pulled.

Unfortunately a lot of older men do fall for younger women. Who, shall shall we say, cause the sap to rise in old wood. This is not judgement of the OP. It is a statement of fact.

What the heart (and other organs) want often overrules the head.

Get a good lawyer. Divorce his wife and report her to USCIS/ICE. Once the pain has gone, chalk it up to experience and maybe search for love/companionship closer to home.

I wish him luck, smooth sailing and in the future maybe a wife who will love him back as much as the love he wants to give.

Women/men no matter how different from what we thought they were aren't things that can be simply shipped back or put in a plane.

You can always count on this lame attack on someone victimized by a green card fraudster.

The person treated as an object is the OP: to be used for a green card. Sending a green card fraud back is the LAW, since entry was illegal. The real irony here is the person doing the attacking is pretending to care more for people than the person they are kicking while he is down. The one whose heart was ripped out mercilessly, finances drained, hopes dashed. By a criminal.

That shows you the real character of the person doing the attacking. In a lynching like this mob psychology always rules too. String him up. He's already been put down and weakened by a criminal so let's just join in on the fun.
