Well ya made me go read. It is not true about needing a court order if consent can not be obtained, only need to complete this form:

And how would you get her child to qualify? What actions can she show that she can not obtain the father's permission? Her words?

You need some proof to file what you posted. Its for xtreme reasons.

It's show us why we should disregard our safeguards to issue a US passport without the other parent's consent.

According to the form.... yup her word. If you are going to reference to the one form that requires a signature you have to accept the other form as well.

Its not that easy. If her words was all that was needed, then why have the requirement for both parents to sign or a court order?

If it was as easy as you believe, then why have the precautions?

This form is only accepted under extreme circumstances.

Hi there. I am trying to get a passport for my son, my exboyfriend signed his birth certificate, but he is not involved with my son. We have been living in the states since 2009, we are in the philippines right now coming back august 24th, I can't obtain my ex's signature. I don't know where he is or what he is doing. Is it hard to get a US passport for my child without my ex's signature?

I am us citizen and I am also Military.

Here is what I found from travel.state.gov website:

If the minor has two parents/guardians, but one is absent and cannot be located to provide parental consent in a timely manner, the applying parent must submit Form DS-5525: Statement of Exigent/Special Family Circumstances. The statement must explain in detail the non-applying parent's or guardian’s unavailability and recent efforts made to contact the non-applying parent. The applying parent also may be required to provide evidence (e.g., custody order, incarceration order, restraining order) to document his/her claim of exigent or special circumstances. To protect against international parental child abduction, the Passport Agency processing the application may ask for additional details if the statement is determined to be insufficient.

We have the same issue, And I will be applying for my son's passport soon.

I take it back, we don't have the same case as my Ex's name's not in my son's birth certificate. The father section of his BC is blank.

Try submitting the DS-5525. Since you are applying at the US Embassy Manila, they are aware of the laws governing illegitimate children that the mothers have sole custody.
