i864 household size

hello everybody

just got email from nvc asked me to correct the household size in part 5, as i live with my sister and her husband at the house so i used them income while my income is not enough and they do have 2 children one is 7 yrs and other is only 2 yrs i add them to part 5, in number 7 which asking to add any relatives who live in our household but NVC asked me to correct that i dont know where to add my sister children as dependent children can you guys please help me i need to know where should i add them to count the total of house hold size

Are you petitioning a wife/husband and your sister is co-sponsor?

If that's the case you have your I-864 and your household size you and spouse.

Than your sister has her I-864 and her household size, plus the immigrant? Does she claim you also on her taxes? If so she would include you husband filed jointly he would also file out the I-864A..

yes i'm petitioning my husband also my sister filled i 864A and her husband too as as i do live with them in the same address and her i864A is fine the only thing is they want me to fix the number in house hold size in my i864 which i put as shown

part 5: sponsor house hold size:

1: inter the number you interred in line 7 and 3= 1 which for my husband

2: yourself :1 which me

3:if you currently married inter 1 for suppose : 0 left it 0 as my husband is the same immigrant

4:if you have dependent drench inter number here: 1 for my baby who live with me

5:if you have any other dependent : i put zero i dont have an more dependent on my tax

6:if you have sponsors or any other persons on an 1864 or i 864ez :0 / we dont have anyone

optional: if you have any sibling, parents or adult children with same principle address : i put 2 for my sister and her husband who already filled i864A also by mistake i put them children so total in this part was 4 / and here where they asked to correct

now i need to change that and dont know in which part i have to put 2 for my sister children dependent

no she didn't claim me on her tax only her children

you do not list their children in your 864. only persons living same place, whose income you are using to help with 864 and are submitting 864.

You would not list their children that way. Does your sister and husband together make enough to meet the requirement for a household of 5, themselves, 2 kids and the intending immigrant? If so, you should re-do the forms and the USC petitioner/sponsor do their I-864 with a household of 3, USC, foreign spouse and child, and the sister should fill out her own I-864 as joint sponsor and have her husband fill out an I-864A to go along with the sister's I-864. Much cleaner and easier to deal with and count the household sizes accurately. Yes, you all live together, but it is really two separate households under one roof.

but the NVC didn't asked for i864 to fill up by my sister the one i sent them was i864A and it was fine they did accepted

should i just count my sister and her husband in the household size ???????????/

I understand that they did not ask for an I-864 instead of the I-864A. The sister qualifies to use the I-864A as a household member. You probably should have gone with the sister being a joint sponsor in the first place though. It would have eliminate the issue you are having now. It is easier to deal with separate households that way.

If you just want to answer the checklist and provide the correct numbers on your I-864, then you simply remove the children. They are not counted on your I-864, only the sister and her husband that filled out an I-864A. The NVC and CO can add up the actual household size tally to make sure the income is sufficient, as the children are listed as dependents on the sister's taxes that she must provide.
