t,

What interviewer? This is the I-130 petition that is being discussed. No interview for I-130.

The visa application is a separate issue.

Yodrak

Ahem,

You don't necessarily need everything on the list. Just enough to satisfy the interviewer that your marriage is valid.

My bad...should be CO.

t

or adjudicator.

As someone above mentioned, in order for the US half of this equation to be able to file their tax return this year, the foreign half will have to fill out a form to get an ITIN from the IRS.

With an ITIN, (tax ID number is what it is), some banks will allow you to open a bank account, so as soon as you get it, the US half can just add their spouse's name to a checking account.

Also, even *without* an SSN or ITIN, some credit unions will let you open a bank account, or be added as a joint on an existing account. So try that.

Don't throw up your arms in dispair without first seeing what you *can* do and the documents you *can* get.

Some of this stuff people have been gathering with their I-130s just as "back up" evidence anyway, and I'm fairly certain that any adjudicator and/or CO is going to be well aware of the hurdles newly married couples face who have not yet had the opportunity to live together in any country because of immigration stuff. This will be taken into account. There's also another space on the form where you will be able to fill in "have not yet lived together" right?

Remember this form is also used by couples who *have* lived together in a foreign country and now just want to go to the US. It is also used by couples who get married in the US and the foreign half decides to stay and adjust, so USCIS is aware that not all things apply to all people. Just think outside the box for a minute and I'm sure you'll come up with something.

As for existing petitions already submitted on old forms, they may or may not send out mass RFEs. Who knows? Don't sweat it until you get it. ;)

Regarding the additional proof that is required for the I-130, what do I exactly need to do for this:

Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship.

I can have people write a letter but I'm not sure what is meant by ''Affidavits sworn to or affirmed by third parties'. Does the letter need to be notarized or is a letter with a signature enough, besides the listed requirements:

- full name and address

- date and place of birth of the person making the affidavit

- his or her relationship to the petitioner ofbeneficiary, if any

- complete information and details explaining how the person acquired his or her knowledge of your marriage

Hey guys, I thought I would pass this on-- you know in the US since we can't add someone to a bank account without having a SS#... but you CAN add them to your credit cards!!! I added my husband to ALL of my credit cards. Now he has his own card and we have a paper trail showing he is on my cards. It's a "comingling of finances" :) I just did this on my own, but now I am glad I did having read this!

Julianna

Just as an FYI, my bank and pension plan allowed me to add my husband by filling out the IRS form W-8BEN - Certificate of Foreign Status of Beneficial Owner of US Tax Withholding. You may try that if you're running into problems adding your spouse to US financial accounts.
