Timeline

My USC fiance is self employed. I already have the i-134 and the 1040. But is there something that would replace W2, which is for employees? Would you know which other forms or certificates we would need? Thank you.

There is nothing else for self employed who are not sub-contractors, just make sure he sent his complete tax return.

Form 1099, Miscellaneous Income. And USEM wants to see it on self-employed 1040 tax returns.

Self employed only get a 1099 if they are contracting to another company, if they are actual self employed there is not a 1099.

There is nothing else for self employed who are not sub-contractors, just make sure he sent his complete tax return.

Self employed only get a 1099 if they are contracting to another company, if they are actual self employed there is not a 1099.

Technically correct, Hank. But, you don't have to be a contractor or sub-contractor to receive a 1099. Any sole proprietor, or member of a partnership or LLC, can receive one. As a general rule, in the course of operating a trade or business, you must issue to each person you have paid at least $600 a year in income payments a 1099 MISC. The most common exceptions are payments to a corporation or sellers of merchandise, freight, storage and rent. And payments for personal purposes.

In my self-employed trade, I don't specifically contract with any one business. I offer my specialized services to to a narrow market, but all who pay for it issue me a 1099 if more than $600 a year.

In your example you are receiving payment from "other" companies, they are required to issue you a 1099.

Joe the sole-proprietor plumber, is self employed is paid for his services by clients, for him to get a 1099 he would have to write it to himself... that is my point.

I am self-employed. Not all of my clients issue me 1099's... I report all my income on my tax return however, whether or not I received a 1099 for it. Will 2 years tax returns be enough? I was going to scan them and email them to my fiancé in the Philippines. Is it ok if I blackout my social security number on the tax returns?

Only need your most recent tax return, not multiple years.

Don't know if the embassy would be happy with it blacked out, besides the embassy already knows your SSN ;)

If your fiancee is taking a copy of your ITR to CFO then for sure have it blacked out, but if you have a divorce decree/death certificate most times CFO does not ask to see a tax return.

Rule of thumb used to be for self employed with no 1099's was the USEM CO looked at a certain line on your taxes to see your income.

I am now self employed and have only a couple of 1099 from 2013, Rare for me to get a 1099 from a business or a customer

I'm self employed and receive 1099's as a contractor, not subcontractor.

I had the bank write a letter that indicated total deposits in my account for the same years I was submitting the tax returns.

Excessive use of acronyms should be a felony.

If you fiance is a student and is not employed, thus having no income you will need a co-sponsor. Co-sponsors with the K-1 visa can be difficult at USEM to say the least, it may be better to go the IR/CR-1 route as the embassy has to accept a co-sponsor then.
