I submitted aos i130/i485 concurrent filing to Chicago Lockbox for my wife on 06/18, who is currently on K-1 status.. However, till now, my checks are not cashed and I haven't receive any message from uscis.

Anyone has the idea how long will they cash my checks and send me NOA1?

It doesn't matter. Your K-1 expired the minute you entered the US. it is a one-time use visa.

If you mean your I-94, overstay will not be a bar to your adjusting.

Thanks.. So you mean it's ok to do aos even if i-94 expires.. but uscis hasn't sent me any acceptance notice

My wife arrived in US on K1. We married with 90 days of arrival.. But when i file her AOS, i concurrent filing i-130 and i-485 at the same time..

Looks like there is no need to file a i130 as we married before her i94 expires.. Can anyone pls advise what to do now?

Yep, that was wrong. But, they will just take your money and proceed as a concurrent case. Sorry. Good luck.

Yep, it takes some time for USCIS to cash the checks updates, etc., a review of recent Family-based AOS Progress threads would likely indicate as such.

No. Someone adjusting from a K-1 does not file an I-130. They are eligible to file for AOS based on the fact that they entered with the K-1 visa and married the USC petitioner within 90 days. You would have only needed to send a copy of your I-129F approval notice.

You wait for them to cash the checks and send you the receipt notices. It can take up to 30 days. Your AOS will now be based on the I-130 you just filed and paid for instead of the I-129F petition.

If your wife came here on a k1, you should have filed I485 to adjust status. All you can do is wait to hear from them. In the meantime, go back and Read the guidelines to adjust status from a k1 visa.

06/10/2015-Went to info pass appt. Hubby got a 1yr. Extension stamp in his passport and biometrics done

08/12/2015-ROC Approved. Got letter in the mail.

08/29/2015-received new card in the mail.
