Timeline

First Mistake – Not appointing an Immigration Attorney!

Hi all, any guidance on below questions would be really appreciated, there’s a lot of contradictory information out there.

DS230 (I & II) and DS2001 posted off yesterday 18JAN07

Questions pertaining to this being:

1. I did not include Xerox of biometric page of passport. Is this required?

2. What are current ‘realistic’ time-scales for interview to be scheduled?

3. Is an I-384 required for the interview – I see a lot of conflicting reports on this

4. Is a full copy of I129F petition required for the interview – same point as above

5. What personal checks are done relating to the DS230 submission – I have never been convicted of a crime or anything

6. What is the % likelihood of their being a problem at this stage i.e. is getting USCIS approval the big one or is it still uncertain as to approval being granted

Very grateful for any help from anyone

First off you may want to enter the details into your profile, it makse answering questions more accurate, detail lacking that I need is what are you filed for? K-1, K-3, CR-1?

1) Not needed when sending packet 3 documents back to Embassy.

2) The timelines on VJ can give you an idea. Go to that page and select your visa type and advance, filter for UK and look at times from returning Packet 3 and interview. This is a good reason that you should to your timeline, it helps you and others to get an idea about what to expect for timing of things.

3) Do you mean I-134 or I-864? Yes one or the other is required depending on Visa tyoe filed for. I-134 is used for K-1,and K-3 visa and I-864 is used for CR-1 and IR-1 visas.

4) A full copy is not required at the interview but highly recommended for the event that something went missing and the consular officer asks for it at the interview, you should have originals of the evidence submitted with the petition.

At Consular stage, there are three (3) Visa Security name checks done: CONDOR, MANTIS AND MORE ANOTHER NCIC (via CLASS)

[Consulate has option, if warranted, to run full gamut of checks, such as CCD (past visa applications & results), TIPOFF (DOS Bureau of Intelligence), NAILS (Nat'l Automated Immigration Lookout System), TECS II (Treasury Dept. database), TSC & TTIC (DOS Terrorist screening)].

CONDOR refers to a check done mostly of information supplied on Form DS-157, and focuses on visa applicants with a potential terrorist, firearms or weapons background. MANTIS refers to when potentially sensitive technologies might be used by the visa applicant in her visit to the U.S. If the visa applicant might employ a "critical-fields" technology in the U.S. which could have a "dual-use" such military or national security application, this check will be done to screen out a high-risk applicant. Most MANTIS checks can be done in 30 days. If not, contact the SAO Problem Resolution Unit at saoinquiries@state.gov.

NCIC (via CLASS) refers to the name check procedure done by the Consulate with the NCIC criminal database at FBI. This procedure screens visa applicants by name to see if there is a "hit" with the criminal database: that is, a person in the criminal database has the same or very similar name to the visa applicant.

6) USCIS has approved you already or you would not be at this stage of the process. At this point not providing the consular officer the information that they request, or the officer sees something that looks like fraud in the paperwork can cause you to have problems.

Timeline now added and yes apologies I did mean I-134 (form dyslexia now attained)

Many thanks for the useful info though and does give me a feel for the last hurdle.

I do have one final question though.

I changed addresses between approval and file being sent to Embassy so I have never actually received packet 3 however printed off the DS forms myself and sent them through in any event.

I believe this contains information on hw to go about booking medical and a medical questionaire

Would anyone happen to have copies of or links to this information as this seems to be the only thing that i have lost out on by not having received packet 3

As an afterthought I have read through many of the posts on this website and find this to be the #1 valuable resource for anyone going through this process and infinitely more useful than any of the embassy, mmigration or attorney web sites!

Question..reading the guides about what to send your fiance for the interview...#2. Originals of everything from the I-129 packet??? You should send your passport and birth certificate originals???

Thanks for the info!

What to send to your fiance(e) once the I-129F is approved (Receive NOA2): 1. A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one).

2. Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy.

Oct 26, 2006 - NOA1

April 5, 2007 - Interview in Rio

April 5, 2007 - Received visa...picked up on April 10

April 16, 2007 - POE Houston

July 14, 2007 - MARRIED!!!

***Green Card****

Oct 8, 2007 - NOAS for AOS/EAD/AP

Feb 15, 2008 - EAD ordered

Feb 21, 2008 - AP appoved

April 2, 2008 - APPROVED and Card Production ordered

***Removal of Conditions***

Jan 20, 2010 - NOA1 - Removal of Conditions
