hello folks

Today I had my interview at new Delhi embassy and I was handed over the 221 white slip as I had no proof to re-establish the domicile of my wife in states.. Shs is living in India since last 6-7 years So they needed a proof which could establish the residence of hers in states.. I did have her E-Ticket of US but it didn't convince her.. So I need to provide them a document like an offer letter from some US company So they know that she will have to live in US for her job but getting an offer letter isn't easy also.. Can she tell her sister in US who has a dental clinic to send her a offer letter for some job? It may not match her qualification as she is bachelors in computers but do we have an option?

And when she gets here, and someone follows up with the clinic to find out that she wasn't hired, and that it was her sister who owned the clinic and there wasn't ever really a valid job offer? You think that might be a problem?

You might be at the "I need an attorney" stage. You should look for a valid and legal way to do this. It sounds like you're looking for *any way* to make this happen, legal or otherwise.

She can work at her sister's clinic for some time till she gets a job in her field so do u think still it could still be illegal?

And also I think whatever check they have to do like to investigate about presence of any such clinic or the offer letter which we submit will happen before I have been issued the visa and not after

I'm not sure that you're at the legal versus illegal stage here. You've got to convince the embassy official that your wife has some sort of...what, job opportunity? She can't come here without a job offer?

I saw at least one indication on the Internet that the consular officers in India use the 221 exception "a lot". You have a hard road ahead of you to get this appealed or overturned.

Give it some time and see what other people say here. You do seem like you want to do this legally. There may be others on here that can give you some better options.

Hi ash20,

Have you looked into what kind of proof they accept for intent to re-establish domicile? What proof have you submitted for this? An offer letter is one option. Does she have a bank account? If she is working in India, has she quit her job? (or have a transfer letter). Does she maintain an address there? (or rent one). Steps to establish domicile could include renting a place in the US, looking for employment etc.
