Timeline

I am asking this for a friend of mine.

She arrived in the country last summer with a K1 visa, got married within the 90 days, but still hasn't filed for AOS yet, cause her husband hasn't filed taxes on 2012 and 2013. They just finished doing the taxes now for 2012 and are working now on 2013 taxes(he might have an extension on 2013 taxes, she didn't know for sure) and they plan on sending the aos package really soon, probably by the next week. Her husband is military and there are 80% chances he might get deployed in Italy this September. My question is, if they file now for AOS, can she ask for an expedite for GC, as it is useless to apply now for AP, cause she has more than 180 days since her i94 expired? And if she asks for expedite, is there a chance she might get the GC by, lets say, mid-September?

There is no expedite for their failure to file in a timeline manner.

Is she going with him to Italy? If not, then no expedite, she can have her interview alone (there is a joint requirement waiver for deployed military). Good luck to them

I don't know that, I'll have to ask her...but if she was, could she ask for expedite? her only concern is that she wants to be allowed back into the country, without having to go through the CR1 process.

Military does not have deployments to Italy, the PCS Soldiers there but not deploy. If the Soldier is being assigned there than it is considered a Permanent Chand of Station to which he is allowed to bring his dependents but they have to be command sponsored, in which case she could ask for expedite

21 Aug 2013: I-129F Sent

11 Feb 2014: Visa APPROVED!

20 May 2014: Wedding!

Military does not have deployments to Italy, the PCS Soldiers there but not deploy. If the Soldier is being assigned there than it is considered a Permanent Chand of Station to which he is allowed to bring his dependents but they have to be command sponsored, in which case she could ask for expedite

Oh, ok, sorry for the confusion...did not know about the PCS Soldiers. I will let her know. Thanks :)
