LPR outside the US, filing I-130. (Manila) Mail or DCF?

LPRs cannot file DCF.

In addition, it sounds as though you have abandoned your residency, since you aren't actually living in the US and have no plans to do so anytime soon.

I've talked to one user here danielenglish who's also from London. He's an LPR who filed thru DCF in London and now just waiting for his PD to become current. I am just not sure if I can do the same here in the PI.

My plan for now is to try and file DCF. If they tell us we can't do it that way, then we'll do it by mail. I hope all works well.

I really don't know if he is going to be questioned regarding his domicile. I didn't bother reading the LPR process in the i-130 instructions. He may go to window 35 at USCIS USEM and they will look at his requirements before he can file and pay for the processing fee. It doesn't hurt to ask and see what they suggest.

If you're in the Philippines you may go to USEM and ask the lady at window 35. I don't think USEM accepts application by mail.

Yes rawkus, that's the plan. We're just preparing all the documents needed and will go to USEM and ask personally. What I meant by mail is when they don't allow me to file DCF then i'll have to do it by mail to their chicago lockbox facility.

Thank you. I really hope all goes well. I am also hoping that maintaining my residency wouldn't be an issue. My us bank accounts and credit cards are still active, I also have a recently renewed driver's license, and all my immediate family are in the US. I am the only one living here for school. Hoping they find that as an acceptable reason to be away temporarily from the US until I get my second degree.

To my knowledge, DCF for LPRs was not possible. London does some weird stuff though so I'm not surprised if they are the outlier here. I would be more concerned about your residency. By your own admission you have scarcely been in the US in the last two years, and aren't planning on returning for another four months or so, and even then not permanently.

I think there's better-than-not chance that CBP will ask you to voluntarily relinquish your green card, and if you say no they would issue you a Notice To Appear in immigration court and ask an immigration judge to revoke it involuntarily.

You are making me worried but thanks for your concern. I have researched about this issue as well and have read so many helpful insights from this thread

It seems that some have done it as well. Also, in the University I am attending, almost everyone in my batch came from the US (Both USC and LPRs) trying to accomplish their degrees here because of the difference in cost of both money and time (Which I think is the main reason why many people who has the option, choose to study abroad). Well, I will keep this issue in mind and better be prepared for it when it comes up but like many others have said in the thread mentioned above. Education is a very acceptable reason.

If it's not too much to ask could you help me visualize the whole timeline and process by enumerating them to me? I'm still confused about the whole process. This is what I know at the moment.

Wait for a visa number

When do I receive and send the packages that contains the I-864 and other stuff?

NOA1 (USCIS acceptance letter/i797c) and NOA2 (USCIS approval letter/i797) will be snail mailed to your US address.

NVC will contact you via email once they issued your case number. You will snail mail the affidavit of support (i864) and IV packages to NVC. Instructions on when and how to pay the affidavit of support fee and immigrant visa fee will be available online here: https://ceac.state.gov/CEAC/

The choice of address and agent (DS261) and DS260 will also be filled out in that website.

LPR's can submit through DCF but most don't meet the requirements of of being an LPR and a resident in a country that allows this. In all it does nothing to speed the total process. You still wait for your date to become current. It does speed the approval of the petition and gets RFE's out of the way now rather than later.
