Hi,

So I'm filing for AOS based on marriage to a US citizen. Her Dad is co-sponsoring as she does not make enough to qualify, and so he has filled out an I-864.

However, the instructions are not very clear.

Does she too have to fill one out?

We saw there was a seperate I-864a, but we're not sure which one we should be using.

Can somebody help guide us through this?

A joint sponsor fills out their own separate I-864, so he should fill out the I-864. An I-864A is used by a qualifying household member to combine incomes with that of the sponsor filling out the I-864.

The USC petitioner/sponsor must fill out their own I-864, even when using a joint sponsor.

1. Who Completes and Signs Form I-864?

A sponsor completes and signs Form I-864. A sponsor is required to be at least 18 years old and domiciled in the
United States, or its territories or possessions (see Part 4, Information on the Sponsor, Item Number 5. of these
instructions for more information on domicile). The petitioning sponsor must sign and complete Form I-864, even if a
joint sponsor also submits an I-864 to meet the income requirement.
