My process is only in its 2 month of waiting, i agree with what has been said. the system will not change anytime soon because for every 1000 persons who do it the legal way , you have another 10,000.00 doing it the illegal way which makes it harder for those who are doing it right. If you are in a long distance relationship which i am also, visit each other, skype, text and find usefull way to help the time pass. After all if you didnt have a KI or K3 to fall back on thats what you would be doing. The wait is hard yes, other CSC petition get approved faster than TSC but thats how the cookie crumbles. Even though your pitition sound good, it would take the 10,000 illegals to join the legal and make the dent of a difference so that the process can go faster for all. just my two cents.

I know how you feel seeing all CSC filers get approved in a month.. Because I feel the same way. And it's unfair, it really is but there is nothing we can really do.. I hate to just sit and wait helplessly but this is the only choice I have. I wish this petition would work, I would gladly sign it, but unfortunately I know that it won't..

What's your stance on the discrepancy between the CSC and the TSC? If the process is the same at each service center, do you not agree that the processing times should be similar? Also, the background check at this point is only performed on the petitioner, someone who is already an american citizen.

Stance is irrelevant. It is annoying to say the least.

The real petition here needs to be a clear and present message from USCIS to all US Petitioners regarding immigration scams that lead to fraudulent VAWA cases. Expediting K-1's and K-3's is a floodgate for fraud in my opinion.

USCIS has a responsibility to warn US Citizens about the real risks of love fraud in the immigration system to the tune of 10's of thousands of cases.

Even if the petition reached 100,000 signatures, the only thing that will happen is the White House will issue a response, not an action. It will likely be along the lines of "The United States of America is a nation of immigrants. We are committed to ensuring that each and every person who wishes to live in the United States of America can do so as quickly as possible. Please understand that each year, tens of thousands of people apply to immigrate to the United States in hopes of pursuing the American Dream. Unfortunately, this may cause some delays. We will continue to work diligently with the Department of Homeland Security and the Department of State to address any issues that may cause delays."

Rough draft, but I'm sure that's not far off from what the response will be.

I would totally sign the petition!

I understand it takes a long time, there are lot of people and they have to be strict, but there has to be some changes!

The stupidest things are that you are not allowed to travel and work for such a long time, the AP/EAD should come way faster. I have been here since november, and my first AOS application was denied due to a missing document,(co sponsors birth certificate). Also it is dumb that they cant keep every applicants papers in one file, i had sent that birth certificate before, for example with the K1 application. But no, they still denied me even though our co sponsor had all his tax info from many years working in a big company etc. Why would we have that, and even send them to the USCIS if he was here illegally?! He was born in the us too, thats what it said on his forms. Even that doesnt confirm them that he is a us citizen or legally here? If they had all my papers in one file, I wouldnt have to send every little paper again and again! Im sure there is technology for all that!

There has to be some changes in the system. I havent been able to travel/work now for 8 months! This juts sucks! I applied for AOS again with a lawyer, hopefully this goes better!

Also their customer service is pointless, they dont tell you anything! Also the infopass appointment is pointless, I went there once and they told exactly the same thing the person on the phone says. You cant even get help for free anywhere, i mean here you can but people here are not lawyers. You have to hire a lawyer to get help and get your stuff moving. LAst time before I got denied, I called the USCIS EVERY day for one month, because my AP/EAD were outside the normal processing time. after 4 months of my NOA's I was told on the phone, it looks like all your papers got denied. And then i had to wait a month to get my denial letter, but again, I paid some money to a lawyer, and he was able to get my the letter faster. I just could not believe all this.

Good system, huh?

Travelled to Finland with my husband for 3 weeks in August. Came back with my Advance Parole, POE in Chicago, no problems with AP.

If you want to be able to work immediately once you reach USA, then you should have go the spousal route, CR1/IR1.

There were only 2 ways for us to get married and move to the us because im from finland.

I dont know what the other visa is called but the only thing we could do was fiance visa, or get married in finland and then apply for a visa/whatever its called, and it takes 1-2 years to hear anything and we are not allowed to live together in the same country while its being processed.

So we chose the K1 since we could live together sooner.

I dont understand why they would care if I traveled to my home country to visit durin my AOS process? I dont get that

A K-1 is a non-immigrant visa. You must apply for permanent residency once you marry within 90 days of entry. You need authorization to work and advance parole for re-entry when traveling. AOS is done within the US by someone with the desire to stay and live in the US. If you leave after filing, then you abandon the AOS process. AP allows an adjustment applicant the ability to travel and re-enter while waiting so that they do not abandon the AOS process. It is a good thing, and not like they have to give you that option, and for free no less. If someone has an emergency they need to leave for, emergency AP is also available sooner. Causal travel can wait a couple months.

As for the RFE you received, a joint sponsor must provide proof of being a USC or LPR with the I-864. It states this clearly in the I-864 form instructions. The USC petitioner/sponsor does not have to provide this again because their US citizenship was already vetted when they filed the I-129F petition. You should not have been denied if you responded to the RFE within the time given.

If you wanted the ability to work and travel abroad as soon as you arrived in the US, then you should have married first and filed for the CR-1 spousal visa instead. With a CR-1, you become a permanent resident upon entry. You chose the K-1 because it was faster. With the speedier process also comes the AOS that must follow. You can visit each other during either process.

Yes it is wrong that the public at large thinks of all immigrants as illegal, even those of us that did it the legal way.

Okay, but I still think the whole system needs to be updated!

In my home country, you can just bring your fiance there and get married without doing ANY paper work (visa etc) and then apply there for residence permit and you get it in a couple months. Little more human?? No waiting in different countries.

I am pretty sure there would be way better options for US immigration system, that is why obama is trying to do his immigration reform, unless i understood very wrong.

And yes we did response to our rfe wrong, we sent our other sponsors birth certificate. people make mistakes, and also USCIS is allowed to make mistakes and go outside the processing times, but when the customer forgets a little paper , or does a little mistake, or is one day late, you get denied. You still think thats fair?

I know i got denied because of our own mistake. But just saying, the system needs to be updated to 2014.

The reason for long wait is number of USCIS employees. Can it get faster? Yes. If they hire more employees. Should they hire more employees? I don't think so. Why other tax payers have to pay for our desire for speedier approvals? There is no point in the petition because publoc will not approve it exactly because of this: increase in number of government employees. Our country budget is unbalanced as is. If you are unwilling to wait for 6-7 months than maybe you should look for someone in your own country.
