I'm not sure if this is the right forum for this question, but my wife who has her green card is interested in taking some classes at our local community college. I was curious if applying for financial aid violates the agreement that we will not take any means tested benefits? I'm really not sure if financial aid comes from the government or not. Please advise.

Hi,

It's perfectly fine for your wife to get college financial aid.

College financial aid is not a means tested benefit that is prohibited under the I-864.

You may want yo check if your wife has met the residency requirements for in-state tuition. New immigrants must often wait to meet state residency requirements or pay oit-of-state tuition until they do meet the residency requirements.

I would like to know for sure, and also if that statement applies to graduate school. And you are talking about student financial aid versus student loan, correct?
