Last weekend I traveled from New Jersey to Cheyenne, Wyoming for a job test and interview for a dispatch job with the Wyoming Highway Patrol. I submitted my application over 2 months ago and passed the review process to go onto the testing/interview stage. I was successful in the test and interview only to be told the day after I got home that although they wanted me for the next stage of application process, I was no longer being considered because I'm not a US Citizen. On the initial application form, it only asked me if I was legally allowed to work, I am as I have a Green Card. My citizenship was never asked. I took 3 days off work and spent $1800 on flights/hotel/car rental/food for a job I was never going to get due to the application form being incorrect. The dispatch manager even admitted that the form only asked if I was legally allowed to work. Obviously I'm mad that I wasted my time and a good chunk of money. Can they do this? Is this citizenship discrimination or should I just deal with it and move on. I really wanted that job!!!

Department of Justice website states:

"1) Citizenship or immigration status discrimination with respect to hiring, firing, and recruitment or referral for a fee by employers with four or more employees.

Employers may not treat individuals differently because they are, or are not, U.S. citizens
or work authorized individuals. U.S. citizens, recent permanent residents, temporary residents, asylees and refugees are protected from citizenship status discrimination. Exceptions: permanent residents who do not apply for naturalization within six months of eligibility are not protected from citizenship status discrimination. Citizenship status discrimination which is otherwise required to comply with law, regulation, executive order, or government contract is permissible by law."

if it's to be a trooper, according the site you must be a us citizen.

It was to be a dispatcher for the troopers, not an actual trooper. Upon googling this position, it seems in all states you have to be a citizen. Good to know so I wont waste my time applying for this job in other states.

Hi,

There are some jobs where you must be a US citzen.

Working for the police usually requires a person to be a US citizen.

As a public policy, most communities do not allow non-citizens to have police power over citizens.

You are not being discriminated against. You have no legal basis to sue.

My father-in-law is the Chief of Police for a town in New York. He works with a lot of other police agencies in his area. All their dispatchers are uniformed officers. None of them are civilians.

Are you sure that the dispatcher job is a civilian position and not a position that requires an officer?

I thought they have Government immunity anyway.

It varies, I know of one Officer who has a green card and in Boulder County there was a dispatcher who had a Green Card. He had an article in the paper.

Very unusual for an officer to be a LPR, less so for a dispatcher.

That's too bad that they had you come just for nothing. The good news, if there is any, is that you seem otherwise qualified for the job. If you wanted it, you could apply again once you become a USC. Good luck.

They admitted the application form was wrong. It didn't ask if i was a citizen and they never stated in the job requirements that I had to be a citizen. They're at fault. If it had said i needed to be a citizen, i wouldn't have applied.

Yes it was a civilian position. No police training required.

They should have made it clear that you were not eligible.

The form is probably a generic application to be filled out by janitors and police chief applicants alike. They leave to the position to enforce the rules of the position. The fact that the from is not specific to the job does not give enough cause to sue,

This will not be over quickly. You will not enjoy this.

How could you sure a Government agency and what would you sue for?

It was no discriminatory according to Fed regs and with the number of applicants to jobs, most are unsuccessful.
