Your current income as counted towards the I-864 is zero because it will not be continuing in the USA. Essentially in their eyes, you're unemployed, or might as well be, for the purpose of that form. They don't care how much you make abroad unless it will be continuing in the USA and you can support the beneficiary. They don't care if you're employable, or a lazy POS, or disabled, or retired...

I think we must agree to disagree on this. Why would NVC ask for proof of current income if they don't care? The 1-864 doesn't ask about future income, they are only concerned that you prove current and past income and that you currently meet the poverty guidelines.

Even if employment was continuing, there is no guarantee with that and you can't prove what you might earn in the future. What if a person quits, gets injured an can no longer work or is fired? The I-864 is a legal agreement that the sponsor will take responsibility of the immigrant and they base that on the sponsor's current financial situation, not what might happen in the future.

Good morning!

DS-261 filled out yesterday. Had a look at the other bits and pieces and AOS had my petitioner name written in, however, today I had a look and his name is missing!

Do you think this is common and is an indication that the AOS invoice is being created?

I did mine yesterday as well. I think they are just uploading the info and maybe thats why the name is missing.

I agree that that the federal government doesn't care about future earnings in a sense. In a way they do as being employed means you're more likely to stay that way (in their mind), but you've promised and are legally bound to repay them no matter what happens. Continuing employment (current income) is more substantial, than otherwise not having it. Having that past income matters in a sense that it does show you're employable, I do agree, but without current employment, yer screwed. US employment or employment that will continue after a petitioner moves is needed or else you need someone else to say they will take the brunt because you do not work. That's why people need joint sponsors. They don't make enough money; they don't work in the USA; their employment won't continue after they move; etc etc etc... Because the petitioner is moving, and that employment will not be continuing, the federal government wants to know the beneficiary won't become a public charge, in any way possible.

What I am saying is, currently, you may be working but that's NOT acceptable to the US federal government. Why? Because your job will NOT continue after you move. You may as well not be working for all the good it does you at the moment.

You're agreeing with me, but you're arguing about why you should put it on a form vs not. You can, of course, I've even said so, but in the end, it doesn't matter, so it's not necessary. You need a joint sponsor.

So if you feel better filling it out and providing where you work, do so. It's not needed, but you'll feel better. :)

I don't think I am arguing, just trying to understand.

I can't find anywhere that says you must have a joint sponsor if you currently meet the the poverty guidelines. It doesn't ask about future/continuing employment or income. My concern about this clarification is real, as I do not have a joint sponsor and I will resign from my job when we move to the States. This is the first I have heard that I need a joint sponsor.

Can anyone with experience in this please answer?

Glad you got the answer, but sorry you have had a checklist for this. Seems like something you could bring to interview, but NVC can ask for what they want and we have to provide it.

I can understand how you would have assumed proving your income wasn't necessary if you have a joint sponsor anyway. I agree with you, they are probably just checking that what you have put is correct. Make sure whatever evidence you submit matches exactly what you have put for Part 6 Q 5 to the penny! I also got checklisted on AOS, but mine was for not putting "zero" in Q 13, as I misunderstood the question and thought they wanted my annual income, not total income as adjusted on 1040 because my income was foreign income. There is just so much paperwork, it is so easy to miss a step and cost ourselves valuable time :cry:

I guess I should submit a new I-864 with the correct income and explain my mistake. Hopefully I won't get another checklist for that!

No worries, glad I could help. Hope you get a speedy review. My IV docs have been approved, so just have to wait on the checklist review, hopefully they will get to it in the next 2 weeks. :whistle: If I hadn't made the mistake on Q 13, I would have had a case complete 2 weeks ago. Oh well, I just have to be patient.

It's terrible that it took them so long to scan it in.

I'm actually in the same boat as you. At the speed they are processing things I'm unlikely to have an interview before September and as of September 1 we'll have been married for 2 years.

I'd be upset with NVC for all the mistakes they are making but I suspect they are horribly overworked at the moment and that is leading to mistakes. At the same time they should have seen this coming and prepared a little better.

I know this may be small consolation for being apart for so long, but getting an IR-1 visa instead of a CR-1 will save you $600 from doing ROC, not to mention the headache of gathering a bunch of documents again.
