You needed to put your current income as ZERO because it will not be continuing. I wouldn't even put where you currently work because it's also not continuing.

Thanks for taking the time to answer my question! I did put my income as zero since foreign earned income is not counted on the 1040, as well as a post-it next to that item reminding them that my income will not continue. I was considering saying I'm unemployed on the AOS form, but I didn't want to get caught lying. I'm on hold with NVC now, so I'll see what they have to say. Thanks again!

I am confused here. I think if the petitioner is living abroad it is assumed their employment is not continuing once they move to the States. The question is asking for current income not continuing income. I had the same situation, as I am the petioner living abroad and I put my current income in question that asked for current income and for the question asking about total income (from taxes), I put zero because my foreign income was not counted on 1040.

In my opinion they aren't asking the question to find out what you will be earning in future, but what you earn now. Maybe it is to gauge what you might be likely to earn in the future when you are employed in the US.

My advice would be to submit what they are asking for to prove current income (pay stubs, letter, etc)

What is your NOA2 date? If it's been several weeks and the NVC hasn't received your case, you should contact USCIS to get confirmation of the date your case was shipped to the NVC. You will need to specifically request to speak to a Tier 2 agent in order to get this information. From there you can work with the NVC to find the case. I hope your case gets to the NVC soon!

I think you're right. For Part 6 Q 5 on the I-864 I put my current income and a post-it note that it will not continue. Then in Part 6 Q 13 I put zero since it's not counted on the 1040.

Regarding the proof of employment, the NVC guy said they need it anyways even though the job won't continue after we move. I guess just to prove I'm not making things up.

N0A2 may 31 . NVC said I shuld scan the N0A2 and email it but I'm still worried . I don't no wat to do or think I have never heard this happening to anyone

Just called NVC, still no updates for our IV packet. Our packet was scanned 2nd of June. :(

Your current income as counted towards the I-864 is zero because it will not be continuing in the USA. Essentially in their eyes, you're unemployed, or might as well be, for the purpose of that form. They don't care how much you make abroad unless it will be continuing in the USA and you can support the beneficiary. They don't care if you're employable, or a lazy POS, or disabled, or retired...

Glad you got the answer, but sorry you have had a checklist for this. Seems like something you could bring to interview, but NVC can ask for what they want and we have to provide it.

I can understand how you would have assumed proving your income wasn't necessary if you have a joint sponsor anyway. I agree with you, they are probably just checking that what you have put is correct. Make sure whatever evidence you submit matches exactly what you have put for Part 6 Q 5 to the penny! I also got checklisted on AOS, but mine was for not putting "zero" in Q 13, as I misunderstood the question and thought they wanted my annual income, not total income as adjusted on 1040 because my income was foreign income. There is just so much paperwork, it is so easy to miss a step and cost ourselves valuable time :cry:

It can take up to 8 weeks for the I-130 to get to the NVC.

However the petitioner can call the USCIS and find out when it was shipped to the NVC.
