form ds260 will be the form you fill out and that is done online only.

As for U.S citizenship for your daughter. I dont think she becomes a U.S. citizen upon entry. I think both parents have to be U.S. citizens when she was born if i am not wrong . But she does qualify for Automatic Acquisition of U.S. Citizenship

http://travel.state.gov/content/travel/english/legal-considerations/us-citizenship-laws-policies/child-citizenship-act.html

Section 320: Automatic Acquisition of U.S. Citizenship for Children Born Outside of the United States and Residing Permanently in the United States

The child must meet the following requirements:

  • Have at least one U.S. citizen parent by birth or naturalization;
  • Be under 18 years of age;
  • Live in the legal and physical custody of the U.S. citizen parent;
  • Be admitted as an immigrant for lawful permanent residence; and

I have a similar case with my son (17) and i will apply for his passport & passport book. I cant go for his naturalization certificate N 600 because there is no guarantee he will be done with the whole process before he turns 18 (October).

Do they really need a naturalization certificate?? I thought that only the I-55 stamp is the only need to get a passport .... why do we need to pay for the naturalization certificate???

Everytin in NVC now is 30 business days. You might receive it before the usual 30 business. But all they will keep telling you is to wait for 30 business day.

30 BUSINESS DAYS = 45 days or a month and half. :bonk:

Well, it sounds a lot better to say "30 business days", eh? :rofl:

So I have a silly (maybe) question. I'm trying to decide if I can file the I-864EZ. I think I meet all the requirements listed, I just don't totally understand what's meant in #3. My only income is from my salary that was shown on a W-2, but do I need to submit copies of my W-2s or can I just submit my tax return transcripts? I thought that was preferred by NVC, but #3 makes it seem like they may want me to "show" my W-2s.

Thanks in advance for helping me to clarify!

  1. You may use Form I-864EZ IF ALL the following conditions apply:

    1. You are the person who filed or is filing the Form I-130, Petition for Alien Relative, for a relative being sponsored;

    2. The relative you are sponsoring is the only person listed on the Form I-130 petition;

    3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former employer(s).

    1. You are the person who filed or is filing the Form I-130, Petition for Alien Relative, for a relative being sponsored;

    2. The relative you are sponsoring is the only person listed on the Form I-130 petition;

    3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former employer(s).

You can use the I-864EZ. The third criteria is just talking about if your income you're using to qualify is based on salary or if you're getting income from other sources. You don't need to include W2s though if you have tax transcripts.

Just answered my own question by reading the I-864EZ instructions more carefully... Oops!

If you provide a photocopy of your tax return(s), you must include a copy of each and every Form W-2 and Form 1099 that relates to your return(s). Do not include copies of these Forms if you provide an IRS transcript of your return(s) rather than a photocopy.

:ot:

Ugh, bad news continues. Apparently the flight my husband's work booked wasn't refundable. So, I still have to pay off the flight and I'll get a credit to my Delta account, minus a $200 cancellation fee >_<

Excuse me while I go cry in a corner at work :crying:
