With using a lawyer there are some downfalls (as I have stated) as well as some benefits...look at my timeline. I have already paid both AoS and IV, both packets go in next week as well as the DS260 getting completed...I had to wait on the lawyer a little bit, but she has provided some benefit, guidance and assistance to someone who does not have the experience on this path.

I think immigration lawyers charge $2,000-$6,000 for an I-130 application. :wacko:

If I had known that I would wait for up to 30 business days (45 days) to pay the IV fee, I would have paid $2,000 to hire an immigration lawyer. :no:

Looking for guidance. We currently have two petitions at NVC right now (CR1 and CR2-stepson) and we are trying to complete our AOS package while waiting for access to CEAC. My husband (petitioner) and i (beneficiary) have two children together as well who are US citizens. They just received their CRBA's, but they have no SSN's so they were not claimed on my husbands taxes. My issue is this for household size. I have been told by NVC that my US citizen children should not be counted on any of the i-864's because they are not listed on my husbands taxes. The rep repeatedly told me this is not a misrepresentation and the I-864 must reflect the petitioners taxes and not what the amendments would be. Also, the petitioners stepson is a dependent , because I am currently unemployed. WE ALL LIVE IN THE SAME HOUSE IN CANADA WITH THE PETITIONER. What should I do??

Someone posted the questions in a separate forum so I copied and pasted in here if someone can help this individual who had an experience filing I-864EZ. Please answer this person questions if you have filed an I-864EZ for your spouse. Thank you.

"Hi VJ members, we are currently filling out i-864ez, and we are not sure what to put on #18:individual annual income. My husband filed as MFS for tax year 2013. He received wage increase since two months ago, and obviously, this increase has not been reflected on 2013 IRS tax return yet.
Im trying to help my hubby to fillout i-864ez but I'm not very familiar with the tax return forms in the US, I hope you can help me....

First question is:

1. Where do we get the answer for #18- are we going to refer to 2013 IRS tax transcript(total income), or do we refer to his recent paystubs which show the increase?

*I'm thinking he should get a letter from his employer stating his current annual income.

I have some other questions:

2. Btw, if we are including paystubs in the AOS package, do they need the originals or just photocopy?

3. I saw some posts saying the beneficiary's alien number can be found on NOA2 hardcopy? Is that true? Coz ours only showed my husband's (petitioner) A number. He is now a USC.

4. On 1-864ez #14: My husband has been a citizen since 1997, if he ticks the box for "I am a US citizen," does he still need to put his A-number parallel to the second option which says "I am an LPR"?"

It took 10.5 months for us to get approved becasue we were stuck with those DACA petetions. And people kept saying Nvc is nothin like Uscis and I was looking forward to it. And now when we come here it's becoming the same hell hole. So please stop calling urself unlucky and complaining. There are much worst cases around here. If anybody is unlucky I think it's us. We faced delays at both places. '7' month approvals I think were the LUCKIEST with us June filers.

I agree 100% I'm tired and offended at people that only spent from 22 days to two months at USCIS crying because they may have to spend an extra 30 days waiting they are totally insensitive! I have thought of not coming to the thread but seem to be obbsessed afraid I might miss some important information. It's just sickening and I want someone in immigration to explain to us how this can happen or are they favoring some? I'm pissed and I just wont hide it, I have the right to express my feelings. :(

1. It's not based on tax information, it's simply how much one is earning CURRENTLY, right NOW. If they're on salary, put the salary amount. If they're paid by the hour, then calculate the yearly amount (wage x hours per week worked x 52 weeks). Pay stubs can be referred to if needed.

2. Photocopies are fine.

3. Not everyone has an A number assigned at this point. Most beneficiaries only get it assigned once the visa is issued. If there's nothing on the NOA1/NOA2, then you don't have an A number yet.

4. Nope, not needed. If you put his A number in the LPR box, then a checklist may be issued since the citizen box was checked.

your dependent children under 21 = 1

The children .. US citizens or not, are COUNTED in the household size , no matter where they live (under 21) .

Thanks Tino! This is what I thought. Also what about the stepson of the petitioner? He also resides in the same home as the petitioner and is only 12. I am his biological mother and spouse of the petitioner, but I am unemployed. Is it fair to say he is a dependent of the petitioner as well?
