For Part 6 line 5 I originally put zero and put a post-it next to that item saying "Foreign-earned Income". I also emphasized in my cover letter that my income will not continue, and that´s why I have a joint-sponsor.

About a month later I received a checklist asking for proof of current employment. I called NVC that same night to say, Do you understand that my job won´t continue in the US? Why do you need proof of my current employment? The NVC guy basically said that if you have a job, whether it will continue or not, you need to show proof of that job via a letter from your employer, pay stubs, etc.

So, I had my HR Manager sign a letter indicating my contract length and annual salary both in Chilean pesos and USD (according to the official exchange rate). I then filled out a new I-864 and in P6L5 put the same salary in USD as indicated in the company letter. In my checklist cover letter, I included these two notes:

Important note regarding Form I-864, Part 6 Question 5:

In the first copy of form I-864 sent in May 2014, I mistakenly put my annual income from my 2013 1040 tax form (zero) in Part 6 Question 5 instead of my current annual income for 2014. In the new copy of form I-864 included in this packet, I have corrected the amount to represent my current individual annual income, as confirmed by the attached job letter from my employer.

Important note regarding job continuity:

I currently live and work in Santiago, Chile, and my current income as indicated in Form I-864 Part 6 Question 5 will not continue upon arrival to the United States. For this reason, my father [NAME] is the joint sponsor.

I´m still waiting on a response regarding the check-list, so unfortunately I can´t tell you if this worked or not. If you find out the correct way to proceed in these situations, I hope you´ll share it with VJ so that other people don´t make the same mistake as I did. Best of luck!

I'd say go with what the tax information says. If you put $0, then you'll likely get a checklist as there's a discrepancy between that and the tax information you provided.

Okay, great thanks for the info.

You should put *exactly* what is on your IRS return or transcript in the line indicated in the instructions.

Even if you claim the foreign earned income exclusion, there are many reasons why this value can be greater than 0. The most common would be interest income from a US bank account.

Hey everyone! My wife just finished talking to a supervisor from NVC about the IV bill. He told her that we can send the IV package even though we haven't payed the bill yet. I'm little confused...

My husband spoke with a supervisor from NVC on Friday and the supervisor said we can send the IV package with the AOS barcode sheet. The supervisor said our IV bill will be unlocked today or tomorrow because its past 30business days already. Fingers crossed to see if it will be unlocked according to the supervisor, but I plan to send the IV package when I receive the IV bill.

Hi savagechair,

Fortunately for me the border to USA is just a short drive down the highway, so I'll be crossing at the border to Niagara Falls, N.Y. right after I get my approval. We plan on driving down to our home in North Carolina and getting our N.C. drivers licenses and switch the ownership and plates to N.C as well, then we'll come back up to Canada to tie up loose ends and drive down there for good end of June 2014. I already confirmed with USCIS that this is ok. They said, once you enter as a permanent resident I can come back to Canada as long as I'm not outside the USA for more than one year.

Thank you for confirming that information about entering as a permanent resident and not being outside of the U.S. for more than one year. That puts my mind at ease because we are in pretty much the same situation but on the other side of the border. :)

This is a bit of a random, pointless post, but my fellow VJ'ers seem to understand that we are all in the same boat and have the same frustrations and sometimes just need to air our thoughts. (Cause my husband is getting tired of listening to my anxiety and whining and stressing out, etc.)

I phoned NVC for the first time today (normally my USC husband does), and after 25 minutes, a lovely robot named Shelley answered my call. She was very polite, but wow completely sans personality. None the less, she confirmed my cc date was 10 July, but was not able to give me an interview date yet. Apparently it's my local consulate that determines this. It's been ten days and I can't imagine Johannesburg (South Africa) is a sprawling immigration hub for the USA.

Growing impatient... 429 days!

On a side note, we've decided to wait until after Dec 12th for my POE date. After waiting this long, might as well TRY obtain 10 year residency as opposed to conditional residency. They owe me that much! And I can't bear to do this again in two years. (Greatest cause for divorce among VJ members: filling out forms, not the 2 year wait).

In the mean time we have decided to go on a little Italian rendezvous to cut the time between now and December. Having seen him for 3 weeks this whole year, we are both suffering! This is no way to live!

Good luck to everyone else, and remember (cheesy saying coming up).....

Hi everyone! Could someone please tell me the protocol for resubmitting documents when you realize you´ve made a mistake? I don´t mean when NVC sends a checklist, but rather, whoops that was wrong and I´m going to send a correct version before any more time goes by. Do I just write on the cover letter that they should please use these new documents and ignore the ones I sent two weeks ago?

The main thing is to enter the US poe with the sealed package they give you within a certain time frame. If you don't, then there could be problems. With me being a Canadian citizen and my wifes Canadian permanent residency good for another 6 years, there's no reason we can't come back here for a while. If by some remote chance we get pulled by a cop for a spot check etc. I'll just show my green card and tell him we're back up to get more stuff to take down, which is not a lie.

So, I've been thinking that maybe it's time to add some more columns to my spreadsheet. As it's now taking longer for pretty much every step, it might be beneficial to see how long it's taking for others. Before, the AOS bill and DS-261 were available pretty soon after the case number was assigned, and then the IV bill didn't take long to be invoiced after the DS-261 was submitted. But, we've all seen how that's changed. So, it may be time to add all these additional steps, as well as have calculations (like the current case number assigned to case complete date) for each step off to the side. Plus, I'm thinking it would make more sense to put the date the packages were scanned rather than when they were sent, since for some people, the packages arrive the next day while others could be a week or more, which skews the data. So, these are the columns I'm thinking about:

Case number assigned

AOS bill available

DS-261 available

AOS package scanned

IV bill available

If a real checklist was issued

I tried calling NVC today and I was able to talk to a rep named Abie. She said that she was able to check our DS-261 and she will have it approved. She advised us to wait for an IV fee invoice email.

I think re-wording the AOS/IV Send to AO/IV Scan date is a great idea, that could give people an idea of when to call NVC to get an update (assuming they use your spreadsheet properly)!

Adding in the check list dates is great idea, too.

If there isn't a big gap in between the DS-261 and the AOS fee being available, maybe those could be consolidated to one column? If there is a gap, forget I said that :lol:

NVC operator wouldn't put me through a supervisor.. Said they "found" our "mail" for the checklist...!?!! I heard about this before with supervisor reviews, I'm pretty sure.. She said they need a bit more time to process our case.. and I simply said "You know it's 30 business days on Friday right?" She didn't give me an answer for that. -.-
