I was wondering something. I mailed in the corrected I-864 on July 9th which was the same day I received the check list email from NVC. Do you I'll be through all this in time to be with family in the US for Thanksgiving in November?

If you sent your checklist document on July 9th, it took about 5 business days for NVC to scan it. So your scan date should be July 15th. Then, you'll add 45 days (around Sept 1st) to find out if you have a CC. :clock:

If you don't get another checklist, you should have an interview at the Montreal Consulate sometime in Oct. So you should be able to move to the US by the end of Oct or early Nov. :dance:

If you get another checklist, it'll delay your process by 2 months so you may not be able to move to the US by the end of this year due to Thanksgiving and Christmas holidays (NVC and Montreal Consulate close those dates). :bonk:

My math is based on the current NVC processing time and how long it takes to get an interview at the Montreal Consulate. :yes:

I've never been with family in USA for their Thanksgiving so it would be kind of special. At least my wife is here in Canada with me, and I'm not actually retiring from my job here until end of June next year. We are just doing this ahead of time so that when I retire, we can just head on down there.

Wow... while we're spending so much more time than normal at NVC, more and more petitions are flooding in. They're going to have to do something or the wait times are going to increase until we're waiting 6 months for things to be reviewed. Then it becomes like another USCIS waiting game o.o I don't see me getting an interview until November or December and I've been at NVC since April.

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I really appreciate the help! Thanks a bunch, stackeria. I've actually found a joint sponsor now with sufficient income, so I don't have to worry about meeting sponsorship requirements. I just want to make sure I'm filling out the correct information in my I-864 form.

Are there any others here that are in the same situation as I am? I've been living and working for the last three years in a foreign country. Since my income is not US sourced I cannot use it to help meet my spouse's sponsorship requirements. If you are could you please share how you filled your I-864 Part 6 lines 5 and 13.a/b/c out? Thanks!

Hi! I was in a similar situation and received a checklist a few weeks ago asking for proof of income even though it is foreign-earned and will not continue once we move. I didn't send it originally because i figured it didn't matter since it won't continue, plus I have a joint sponsor. I agree that for 13 a/b/c you should put zero, but for part 6 line 5 (current income) I'm honestly still confused as to what I should have put originally to not receive a checklist.

Given that the system and form instructions are very biased towards USCs living in the US and not abroad with their spouses, I would highly recommend you call or email them directly for an answer to your question. Unless you can find someone in your situation who did not get a checklist and do exactly what they did, it's probably safer to contact NVC directly. Getting a checklist used to mean a few weeks difference in approval, but with how things are now you are looking at a 1.5 month delay.

As you can probably tell, I have major regret over not looking into this more closely myself. :cry:

I would get the new passport asap and bring both to the interview. Don't tell NVC anything unless it is your intent to let the process drag (you gave me that impression on more than one occasion). Their role is artificial and a total waste of time. It might be a good idea to email a copy of the new passport to the embassy after they receive your case. Just be sure to mention your case # in that email.

thank u so much for ur reply i wanted the same as u mention.. so i will let them know through enail once the embassy get my case.. i m scared if i send the copy of passport to NVC they will again give us 45 regular days so i can't really wait anymore ..

It's so frustrating all this stress we have to go through. All my relatives and friends in the US keep wondering why it's taking so long. I tell them we're still waiting and they say but you're from Canada and have been married for going on 12 years! I know I have to wait my turn like everyone else, but that's how most of them see it.

I am really sorry to hear this lottry. I know how u must be feeling. We are all in the same boat. These little steps make us happy at Nvc but then again there is long waiting. Since u have already quit everything so u should go but please don't give up. U have come a long way and so have all of us. I m sure we are gonna make thru real fast!! Good luck! :)

Needless to say this is very frustrating. To top it all off my husbands contract in Japan is now ending and we have to change the embassy from Japan to his home country of France. Another process that is going to elongate this process.

We applied in November thinking this process would take less then a year but it is not looking likely. I asked the last NVC guy when we would likely get an interview if we are approved and he said probably November. This is putting our lives on hold!

Is there anything else I can do to get this moving? I have called NVC about 4 times to check on things, but I don't think that is helping at all. :cry:

As long as you don't reach case closed before the change is approved, it doesn't necessarily have to elongate the process. It took us from sending an e-mail May 24 all the way to July 18 (a couple days ago) to get my husband's change of embassy approved, but we continued with the process normally, as instructed. You can see more details in my signature. It did not delay the process for us at all, but his work contract here (in the new country) is up in mid September, so we were getting to the point where we were thinking of calling and trying to cancel the change! That's how damn long it took. But to change it back to Colombia, ugh, I don't even want to think about it. So it's looking likely that we'll have a month or two (or three?) here in Argentina using the savings that were intended for our new life in the U.S. to pay rent and twiddle our thumbs as we wait before he's actually able to do the interview. :/

Maybe you could call and see if there's evidence you could include for him before he actually moves, so you can get that e-mail in now? I wish there were a separate e-mail address for important stuff like this that has to be done by e-mail. Instead, we have to use the same one everyone uses for questions they could just as well ask over the phone. I'd call and ask about your situation as it is, just to make sure you get the proper instructions. Good luck!

March 28, 2014: I-130 sent via FedEx from Bogotá to Chicago Lockbox

April 1, 2014: Delivered to Chicago Lockbox at 10:29 a.m. according to FedEx tracking; signed for by J. CHYBA (date confirmed by My Case Status)

April 4, 2014: NOA1 e-mail received at 12:17 a.m.; case accepted and routed to CSC for processing. Check cashed.

April 17, 2014: Changed mailing address with USCIS Tier 2 representative. He also confirmed that our case had arrived to the CSC and that our NOA1 date is April 3.

April 18, 2014: NOA2 e-mail received at 12:30 a.m. Case status online changed to post-decision activity; date of "last updated" changed to April 17. Change of address e-mail received at 3 a.m. Status changed back to initial review on e-mail and online. Date of "last updated" now April 18. Called and spoke to two Tier 2 reps; both were useless.

April 21, 2014: Approval confirmed verbally by Tier 2 rep. Order put in to send second NOA2 hard copy to new address. Instructed to ignore online case status.

April 25 or 26, 2014: NOA1 hard copy arrives to old apartment in Bogotá. Priority date actually April 1. (April 3 was the notice date.)

May 16: USCIS change of address e-mail received

May 19: USCIS e-mail received saying a duplicate notice was mailed on this date. Case status now set to "Acceptance."

May 22: NOA2 duplicate hard copy arrives to U.S. address

April 29, 2014: Case received

​May 22, 2014: Case number and IIN assigned. Asked operator about our move from Colombia to Argentina and received instructions.

May 24, 2014: E-mails about embassy change/address change sent to nvcinquiry@state.gov at 4:36 p.m. NVC time

Trying to get a head start on the AOS I-864 form and have some questions. Figured I would ask in here before creating a thread. Trying searching but couldnt find answers

1) For the household size, do we put current household size?? (IE what was put on 2013 tax returns). The reason I am asking is because we will get my wifes parents to co-sponsor. They had more dependents in 2011 and 2012 (3) then they do in 2013 (1). So that would make a difference in terms of the poverty line. If someone can clarify, it would be appreciated!

2) Also my wife started working this year (July) and makes more than the poverty line now. But for the past three years she was unemployed/part time work. She was in school. So can we use her current income to meet the poverty guideline? If we can then we wont need a co-sponsor. Her tax returns in 2013, 2012, 2011 pretty much had close to zero income.

Any input would be appreciated.

1. Yes, it's based on CURRENT household size. But that doesn't mean 2013, that means current, as in right NOW. Not any previous years.

2. Although she may be over the poverty line currently, NVC (and the embassy/consulate) does look at previous years' income, so if she's close to zero, then it's highly recommended you get a joint sponsor.

In other news, made it safely back to Fargo from Minneapolis a couple of hours ago :) Finally back on my desktop computer which I've missed so much *hugs computer* There seriously needs to be a geeky emoticon :lol:

Haha! It's nice and hot here in Fargo :P But I think I'm gonna let my Prius rest a bit ;) Although, I did get excellent gas mileage there and back. Around 50mpg!! At some point, going from somewhere to somewhere in the cities, I got 77mpg! :wow: Highest I've seen yet!
