Thanks a lot for the information stackeria. Does that mean that I have to fill in $0 for Part 6 Item Number 5 and Item Numbers 13.a.1-3 of the I-864 even though I have made a non US based income? Thanks again for any feedback.

For Part 6 lines 13.a/b/c I would follow the instructions on the form (1040 "total income" OR 1040EZ "adjusted gross income"). If you used the foreign earned income exclusion those years, this will likely be 0. I suspect that if you used a foreign tax credit, then those values would not be 0 but they still wouldn't help you meet income requirements.

For Part 6 line 5, the I-864 instructions state: "Enter your current individual earned or retirement annual income that you are using to meet the requirements of this form and indicate the total on this line."

I'm using US sourced income to meet my sponsorship requirements so I'm not the best source of information for your case.

Based on what I've read on VJ, affidavit of support income requirements can only be met with US sourced income. This means any figure you put in part 6 line 5 must be backed up with evidence that it is current and will continue to be the annual income of the sponsor when she re-establishes domicile in the USA. Typically you would require a US employment letter and pay stubs as evidence. If the sponsor cannot provide any evidence of ongoing US sourced income upon returning to the US then I think she needs to enter 0.

Hopefully someone with more relevant experience can confirm or deny this for you.

I'm the USC petitioner. My wife is British (now a USC!!!), generally awesome, and amazingly patient.

I am addicted to this forum too, I have my CC and interview date...still come here to read everyones progress and always happy to see people getting one step closer to their love ones. What I will do when I have Visa on hand? We need to create VJ detox forum.. :rofl::rofl:

Am over addicted, whenever am not at home, am always checking my cell phone for notification updates. A VJ detox is a good idea or maybe hanging out in real life will be good too.

Oh boy I made a mistake on the DS-260 forgot to put the address we lived at when we got married and I sent it. Now what do I do :(? Anyone know? (F) (L) (F)

If you haven't sent the IV packet yet, include the missing info in the cover letter there. Otherwise, mention the missed address to the CO during the interview. I think it would only be an issue if it would trigger the need for a police certificate from a totally different jurisdiction than what you provided already, or the stay was in a US address. In any case, if you stayed there less than 6 months, don't bother.

Saylin, on the DS-260 we don't know my husbands mothers date of birth do we just put "I don't know" ? Will they care?

Since my husband fell asleep poor baby at the computer so I'll have to send it electronically, under preparer they ask for passport number is that mine or my husbands? Again over thinking things. :(

Ok, so first time using the mobile version and then full version on my phone and I see no multi quote option. D'oh! Well hopefully this hasn't been answered, but no, it won't matter if you check off 'I don't know'. They have that option available for a reason ;)

And I currently don't have access to look at the DS-260 form, but if it's in the preparer section, I'm assuming it's referring to the preparer.

P.S. I blame my husband for making me use my phone to check this thread. I was going to on my laptop, but he was starving, so I wasn't allowed to. So here I am at Perkins, checking this thread. *insert pissed off emoticon*

Don't worry. Just mention it at the interview. Or if you want and haven't sent the IV package, then include a paragraph or two in the cover letter about it.

Hello!

Im filling out my I-864 this weekend and I think im done just had a few last questions to make sure im doing it correctly.

- I am proving support with assets as i do not meet the income requirement working abroad. My husband/indenting immigrant will also contribute his assets so we are well above the required amount. In the instructions it says, "page 7 of 13 part 7 6.-8 The form I-864a is not required to document the indenting immigrant's assets." When I called and spoke with NVC I was told to fill out the I-864 and to have my husband fill out the I-864a(he was a bit short with me so I didnt question him). Does anyone know if they require the I-864a even though it says its not required? I know the NVC is tricky sometimes so I just wanted to check with the world of the experienced here :star:

For Part 4 question 5 Country of Domicile - Not sure if I can put both Chile/USA, I reside in Chile but will provide documents of my US mailing address and how I have maintained life in the US with the cover letter suggested in the wikki. (i do not own property in US) Any advice of what to put?

Part 6 Sponsor income and employment - Im employed abroad so I put it, but I want to make sure they are not asking just for USA employment.

Trying to get a head start on the AOS I-864 form and have some questions. Figured I would ask in here before creating a thread. Trying searching but couldnt find answers

1) For the household size, do we put current household size?? (IE what was put on 2013 tax returns). The reason I am asking is because we will get my wifes parents to co-sponsor. They had more dependents in 2011 and 2012 (3) then they do in 2013 (1). So that would make a difference in terms of the poverty line. If someone can clarify, it would be appreciated!

2) Also my wife started working this year (July) and makes more than the poverty line now. But for the past three years she was unemployed/part time work. She was in school. So can we use her current income to meet the poverty guideline? If we can then we wont need a co-sponsor. Her tax returns in 2013, 2012, 2011 pretty much had close to zero income.

Any input would be appreciated.

I really appreciate the help! Thanks a bunch, stackeria. I've actually found a joint sponsor now with sufficient income, so I don't have to worry about meeting sponsorship requirements. I just want to make sure I'm filling out the correct information in my I-864 form.

Are there any others here that are in the same situation as I am? I've been living and working for the last three years in a foreign country. Since my income is not US sourced I cannot use it to help meet my spouse's sponsorship requirements. If you are could you please share how you filled your I-864 Part 6 lines 5 and 13.a/b/c out? Thanks!

No problem! in this case Yes, you can use her current expected income and put it in Part 6 question 5 and provide proof. I suggest reading page 5 of 13 in the I-864 instructions under part 6 item 5. It has examples of what proof is accepted. With this proof I dont think it matters so much as what her past income was just that now she can support you. Someone correct me if im wrong!

I have read on this forum before about calculating your expected income, but Im not 100% sure how to do it so maybe someone else can help if you have further questions about that.
