Hello Everyone,

I'm new to the NVC stage, I'm a Dec2013 filer my husband is the USC and Im the aussie applicant i have paid the AOS bill and currently gathering all our evidence to send it. I tried to pay the IV fee as well but it wont let me (I think from what ive read you have to wait til after they put in the DS-261- choice of agent info- is that correct?)

Also i have one more question as I tried asking NVC when i rang to change our address but the lady wasnt helpful at all, My husband is a permanent resident in Australia and has lived here for 6 years so I know we need a joint sponsor who will be me husbands brother but my question is do we send my husbands AOS first and wait for them to say we need a joint sponsor (which we already know) or are we able to send it all together?

The part in bold - yes, that is correct. It's currently taking about 25-35 business days between NVC receiving your DS-261 and receiving the IV fee invoice.

The second part, you should send your husband's I-864 and your joint sponsor's I-864 all together in one package. Since the number of pages starts to add up in these situations, I think it's a pretty good idea to attach a cover letter outlining the contents of the package. So it would be bar-coded cover letter first, then your cover letter, then the rest of the contents.

Hi everyone this is out of topic but im here asking for my uncle's case he's a greencardholder and LPR int he states now hes petitioning his wife and daughter he recently got a letter from nvc and he didnt know what to do or understood what the letter says.

The letter says that "We can process the visa application under either petition however if you choose for your child to process as a derivative on your spouse case he or she will be ineligible for further processing if you naturalize.

If you naturalize the visa category will change, the immigration and nationality act does not allow derivative status for family member of immediate relative. This means that spouse and children of us citizen requires separate petition to immigrate to the united states.

Please choose your preferred method below:

1. I would like the process accompanying beneficiaries under my spouse petition or

2. I would like the process accompanying beneficiaries under their own petition ..

Pls if any of you guys know or can give advise or have the same situation of my uncle that could be a great help! Thanks

Seriously I don't think we mind these posts! I actually feel sad when I come to read the thread and it's dead! So better to have some life on it even it's just chit chat. If u don't like the post just skip it. It's not hard to tell difference from personal post and posts regarding Nvc at a glance. I do it all the time! But everybody is really frustrated here and we understand each other real well, sometimes better than our family! So if someone feels better when they whine or chat here let it be.

US citizens must file separate petitions for spouse and each child, even when they're under 18 years. LPRs can file a single petition for spouse and all under-18 children. Odd but true.

If he's an LPR and files one petition for both wife and daughter, and he decides to become a US citizen before they get their visas, then the daughter's part of the petition will be cancelled outright. Ouch!

Better file two separate petitions from the beginning unless he's certain he will remain LPR for the next 2 years.

By the way, separate petitions will similarly protect the daughter in the cases of divorce or death of spouse. If any of these three events occur (petitioner naturalizes, gets divorced or gets widowed), a fresh petition for the daughter must be filed, if she was on the same petition with her alien parent.
