What is the estimated remaining time to get an appointment for an interview. ???

Please start by reading the first post in this thread and the wiki it links to. This will answer a lot of your questions and help you prepare for what's to come.

Right now, the NVC is backlogged and it's taking 4-5 months for people to get through. After that, how long it takes to get an interview depends on your embassy. There are helpful hints in the first post and wiki that will help you find out how long you can expect to wait at your embassy.

I'm not quite clear what you're trying to say.

The household size (lines 16) on the I-864ez is 2 (my husband and me). The number of dependants on the tax form is 0 (1 if my husband counts himself). The checklist states:

2> 1 so what am I doing wrong?

Hi,

So it looks like we got a conditional case complete. The conditional part is that we still have a checklist that I now have to bring to the interview:

What happened is that we didn't have the 2013 taxes done in time for the AOS, so we submitted the extension paperwork (4868) instead. Thus we gave them the 2013 income information (section 18 of the I-864ez), but the 2012,2011,2010 tax information (section 19) and the 4868 for 2013.

The good news is that we how have the tax information for 2013 so I will be bringing a copy of the tax return and the tax transcript. This should satisfy the "supporting documents", right? Do I also need to fill out a new, signed, I-846ez to bring to the interview?

My real question is about the "sponsor's household size" section: The sum of lines 16 is 2, and the number of individuals claimed on the 2012 tax return is 0, 1 if he counts himself (I, the beneficiary, am not living with him so do not qualify as a dependant). 2>0, so I don't see what's wrong. Do they just want to make sure that the number is still 0/1 on the 2013 tax return? Also, where does it state the number of dependants on the tax transcript? Is there something I'm supposed to do?

I really want to get through the interview with all the correct paperwork. Thank you in advance for your help.

Yeah, NVC loves to use confusing or incorrect terms in their checklists. After dealing with these jokers, I have total respect for the IRS now.

I read your checklist as: "Your 2013 IRS transcript will need to match the total income and household size you reported on the I-864EZ." I'm not too familiar with the I-864EZ but if you don't need to change anything on the form, the old one is probably OK.

IRS transcripts list the "exemption number" near the top including details of any dependents. It sounds like in your case the "exemption number" should be 1 and there will be no dependents listed.

Did you reopened it after completing? If so, then how many days from the day you've submitted it? Because I also reopened my ds-261 like 2 hours after submission so I was worried after reading the stuff about reopening it but one of our friends here told me that it's fine for me. It's for the people who reopened it 2-3wks after their submission because it will start again the waiting time of their IV fee invoice. Also called NVC but it's not in their system yet since I submitted it just yesterday. Gonna call next week just to confirm.

Well I opened it as soon as I completed it, I wanted to see what what will open, since they made it that you can click on it. And, unfortunately, I opened it again after a week or so.

I'll call them Monday, I have confirmation number that we submitted it on July 9, hopefully that would help.

I don't know why they specifically brought up the exemptions/dependents in your case. As far as I know, the requirement is that all exemptions claimed on the sponsor's 2013 IRS return need to be accounted for in the affidavit of support. It's not just that one number has to be greater than or equal to the other. If the sponsor's 2013 exemption number is 1 and the affidavit of support household size is reported as 2 (sponsor + beneficiary) then I believe you are covered.

I'm pretty sure the most recent tax year on line 19 of the I-864EZ needs to be 2013. If that's not the case for you, I would prepare a new I-864EZ with 2013/2012/2011 income information on line 19 and bring that along to the interview along with a copy of the one previously submitted to the NVC.

Keep in mind I'm not a lawyer or an accountant though! I would do as you suggest and call the NVC to check what they want you to bring to the interview.

As far as I know, the requirement is that all exemptions claimed on the sponsor's 2013 IRS return need to be accounted for in the affidavit of support. It's not just that one number has to be greater than or equal to the other. If the sponsor's 2013 exemption number is 1 and the affidavit of support household size is reported as 2 (sponsor + beneficiary) then I believe you are covered.

We hadn't filed the 2013 taxes yet, we only had the extension. We called the NVC and they said to use the 2012 info for line 19 and include the 4868 in the AOS package (which matched the experiences of VJ posters). In any case, I think I will do as you suggest and bring both the 2013/2012/2011 and the 2012/2011/2010 + 2013 4868 and see which one they want.

Yeah, it's that exemptions/dependents that worries me since I think it is correct. I'd hate to be proven wrong at the interview.

We hadn't filed the 2013 taxes yet, we only had the extension. We called the NVC and they said to use the 2012 info for line 19 and include the 4868 in the AOS package (which matched the experiences of VJ posters). In any case, I think I will do as you suggest and bring both the 2013/2012/2011 and the 2012/2011/2010 + 2013 4868 and see which one they want.

Yeah, it's that exemptions/dependents that worries me since I think it is correct. I'd hate to be proven wrong at the interview.

My guess is they just want to make sure the sponsor's 2013 IRS transcript income and exemptions still meet the requirements. Maybe someone who has used a 4868 for the most recent tax year at the NVC stage can comment on what they were asked to bring to the interview.

NVC likes to keep their instructions cryptic and/or inaccurate so it's best to call and ask. Something tells me your call is very important to them and they look forward to speaking with yooooouuuuu. :)

Don't worry Koko they are taking their time some 30 days some 35, yes call that is the only way you will find out and you will have to wait until Monday. :(

You know how they say you become like your spouse? I think it's true, I was supposed to call NVC Friday and I didn't hahahahaa I'm a serial procrastinator trainee. :P

Your AOS was scanned 15 business days ago. It's currently taking them about 30 business days so it's not likely they would have reviewed it yet.

If you've given them your email before, checklists are usually emailed a day after they are generated. Because they like to keep us guessing, CC emails are sent about a week after approval. If you look on the wiki linked in post 1 of this thread, you will see useful information including a tip about the AOS fee turning to N/A when you get a CC.
