I hope more and more will get this lucky... the less waiting for the rest of us. Unfortunately, calling the relatively tiny number of expedited approvals a drop in the bucket would be a gross exaggeration.

I've read the NVC wiki and scoured the internet for this information but can't find it anywhere. I am the petitioner (U.S. citizen) and I want to be the sole sponsor for my wife, the beneficiary. I have been solely working abroad for the past three years so therefore I have never received any IRS W2 tax forms from my employer because I work for a Taiwanese company in Taiwan. However, I do receive W2 like tax forms from the Taiwanese government that state my annual income and the taxes withheld and I do have my U.S. tax return (Form 1040 and 2555-EZ).

I have the required assets to be eligible to be to sole sponsor of my wife but I don't understand which I-864 form to fill out and if I have to use a co-sponsor. It would be very beneficial for us to not have to find a co-sponsor. Any help would be greatly appreciated!

Hi,

So it looks like we got a conditional case complete. The conditional part is that we still have a checklist that I now have to bring to the interview:

Supporting Documents missing or incomplete

[x] A written statement/explanation as to why tax returns were not filed is required if you are/have been unemployed, retired or dependent.

[x] The listed income tax documents/IRS statements for the years marked below are missing/incomplete (if you have lost any of the requested tax information, contact your local IRS office to obtain a copy) (Only Federal returns (not state or local) are acceptable unless the sponsor's income was earned in Puerto Rico.)
Federal income tax returns, literal printouts from the IRS (RTFTP) or a Letter 1722 issued by IRS

Part 4 Sponsor's Household Size

[x] The sum of Lines 16a, 16b, 16c and 16e should be equal or greater than the number of dependents claimed on the most recent federal tax return. Therefore, this section must be amended to reflect all individuals claimed as dependents on the Federal tax return, or to include an explanation of why these individuals no longer qualify as dependents.

What happened is that we didn't have the 2013 taxes done in time for the AOS, so we submitted the extension paperwork (4868) instead. Thus we gave them the 2013 income information (section 18 of the I-864ez), but the 2012,2011,2010 tax information (section 19) and the 4868 for 2013.

The good news is that we how have the tax information for 2013 so I will be bringing a copy of the tax return and the tax transcript. This should satisfy the "supporting documents", right? Do I also need to fill out a new, signed, I-846ez to bring to the interview?

My real question is about the "sponsor's household size" section: The sum of lines 16 is 2, and the number of individuals claimed on the 2012 tax return is 0, 1 if he counts himself (I, the beneficiary, am not living with him so do not qualify as a dependant). 2>0, so I don't see what's wrong. Do they just want to make sure that the number is still 0/1 on the 2013 tax return? Also, where does it state the number of dependants on the tax transcript? Is there something I'm supposed to do?

I really want to get through the interview with all the correct paperwork. Thank you in advance for your help.

The I-864EZ is for primary sponsors who use US based income to meet the financial requirements. That's not you. I believe you will need to fill in an I-864.

The I-864 instructions on the USCIS website explain how to use assets to supplement (or replace the lack of) US based income.

Searching the forums on this topic, you will find some posters who have successfully used assets to qualify. As far as I know, the assets need to be US based and liquid and it apparently helps to be well over the listed minimum amounts.

If you took the foreign exclusion on your Taiwan sourced income, it is not included in the "total income" (1040 line 22) that you report on the I-864 and does not contribute to meet the affidavit of support financial requirements.

If you have a sponsor you would be added to the total of his household If not mistaken because he will be responsible for you needed or not. So I would think the total for household would be TWO. Has nothing to do with what he claimed on his taxes. :D.

I'm not quite clear what you're trying to say.

The household size (lines 16) on the I-864ez is 2 (my husband and me). The number of dependants on the tax form is 0 (1 if my husband counts himself). The checklist states:
