NVC Filers - July 2014

I moved to a new apartment recently, but my roommates still live at my old address, so I was able to get my NOA2 anyway at my old address. I didn't want to change my address while at USCIS because I heard it was a huge pain.

What is the protocol for changing address while at NVC? Can I just call? If I do so is it just something they input immediately or is it going to cause a delay in my case? I would just keep using my old address, but my taxes this year have my new address, so I figure I should be consistent.

Any help much appreciated!

Hi all,

I finally heard from NVC regarding my case. I received a document check list. We had to make some corrections on my wife's I864 form. We entered her gross income wrong forgetting that the foreign income exclusion makes it zero. They also asked us to send a copy of her North Carolina birth certificate and a recent pay stub from her employer here in Canada. Not sure why they want a pay stub from her job here in Canada when it won't count anyways. Anyways, we've got it all done and ready to go. Going to drop it off at the post office tonight.

Could you please explain what you mean by foreign income exclusion? Since I chose married filing separately, I did report my husband's income earned abroad at the direction of an IRS agent and an accountant (although it is not much and certainly didn't change my tax bracket) So, the line on my 1040A of my gross total income (which is what I am supposed to report on the I-864) does include my husband's income. Thats why I am wondering exactly what you mean by "foreign income exclusion" Thanks in advance!

I can't answer your question, but it might be cheaper to buy some Skype credit and use that?

IV Package received June 3, 2014...

I just spent 45 minutes on hold with NVC: "We'll review the package within 30 business days." She was nice at least.

I never got any checklist, false or real and my case is complete. In fact I was tired of calling every other day and not even one package would be approved which caused a couple of nightmares. I went from approved nothing to CC one fine day which was yesterday! All the best!

call them... I am in Peru and it is very expensive for me to call but I used Magicjack yesterday and called them... it is free calls for usa, I hope it helps you

I asked this question of USCIS and all you have to do is call with the new address. If you wait for NVC you can e-mail the change but it will take at least 30 business days or more. I asked USCIS if it would delay my petition and they said no. I wish I had gone through USCIS for the change of address. Hope that helps.

Checklist!? Oh, No! I couldn't tell from your timeline, but if you're still waiting for the IV fee invoice, it won't delay your timeline. You can send the requested documents with your IV package.

Did you mention that her employment in Canada was continuing after moving to the US (transferring to a US office or working from home)? If not, it doesn't make sense that NVC wants to see her pay stubs. However, it's better and quicker to supply the requested documents rather than arguing with them at this point.

Hi AustinCanada, we've already paid the IV fee invoice as well as the AOS fee. I called the NVC and got through pretty quick. They told me just to correct the mistakes on the I864 and provide the birth certificate and recent pay stub. He said everything else I provided looked great. I wanted to say didn't you get a copy of my wife's birth certificate when USCIS forwarded the approved I-130? And ask why the pay stub, when foreign income doesn't count and my step daughter in the US is already a joint sponsor. But like you said, it's not worth saying anything. Hopefully, they'll give me a quick case closed when they receive the letter and schedule my interview soon after. Good luck for the rest of you green card adventure!

I think your accountant needs to have a conversation with the IRS lol I called them 3 times before I filed and got the same answer every time.

When your foreign spouse os overseas and your spouse is not going to request an ITIN, you can't take the spousal exemption (because they're not here and you're not supporting them over here) - but you're married. Married is married, think Sixteen Candles and Long Duck Dong's conversation with Jake Ryan!

You can't e-file without a social security number, so you have to mail it in and write NRA on the spouse's social. Some accountants think because you can't e-file you can't do it lol I filed married separate and there was no issue :-)

We did the same thing. My wife also printed the form for ITIN, signed and mailed to me. The IRS assigned her ITIN and issued our refund all at the same time. I had a "tax expert" tell me I could only file single even after telling them what our lady Saylin had to say about it.
