Need confirmation on proof of on-going marriage

hi guys, how are you? I have read all the instructions on this website, and would like some clarification on the section 7 of 130.

Do I need to submit any evidence of on-going marriage like stated in 130? Many people told me that i dont need it. can someone who has done this before confirm? Thanks

Timeline

They're not necessary since those are just suggested supporting evidence for the I-130. The I-129F doesn't ask for anything for K3s. The old I-130 form I used didn't mention it at all. If you have something (letters, boarding passings, phone bills, etc.) then send copies. You'll feel better knowing they're submitted. If I was filing now with the new form, I would have included some things.

AOS & EAD Timeline

2007-04-16: I-485 and I-765 sent to Chicago (My AOS/EAD checklist)

2007-04-17: Received at Chicago

2007-04-23: NOA1 date (both)

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

Hmmm i'd say things have changed a little bit.. the new section 7 includes this after it

NOTE: In addition to the required documentation listed in 1)through 4) above, you should submit one or more of thefollowing types of documentation that may evidence that bonafides of your marriage:

1) Documentation showing joint ownership or property;

or2) A lease showing joint tenancy of a common residence;

or3) Documentation showing co-mingling of financialresources;

or4) Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together;

or5) Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage);

or6) Any other relevant documentation to establish that thereis an ongoing marital union.

Up until recently I would have answered your questionas follows: 'No, the purpose of the petition is recognize that a marriage exists, qualifying the beneficiary to apply for a marriage-based visa. Proving that the marriage is bona fide is associated with the visa application itself and is addressed by the consulate.'

It appears that the USCIS is now becoming more interested on the issue of whether or not the marriage is bona fide. The petition now asks for such evidence, it would be prudent to provide it.
