Hey Guys,

I raised the request to expedite my case on thursday last week and no one called or emailed to get any supporting documents. Monday I got an email saying the request has been denied. I have the letter from my employer explaining the situation and why my request needs to be expedited. But since they denied without asking, I am just sitting on the letter. I called them now again and now they are saying they can not reopen the request or create a new request for 30 days. Has anyone gone thru this?

Too bad it went that way. I had the same thing happen to me, but the rep re-filed it right away because the information that should have been in there was not entered by the original rep. The original rep just filed it under serious financial loss, and wrote that I wanted to start working. WTH? Second filing said that I had an offer letter and was loosing money by not starting my new job.

You need to emphasize that you will suffer serious financial loss/stress and that you have an offer letter or letter from employer stating that you can't continue working unless you get your EAD and that you will lose your income. The letter needs to include your annual income. Have them read the information from the past expedite and tell them it's wrong (if it's wrong). The request need to say you have proof in form of a letter and that you can't continue working. Have them read it back to you before you hang up If they still don't want to re-file, ask to speak to a Tier 2. If that is not successfully, contact your local congressman and tell them your story. File through them and tell them it's URGENT. Include your letter as well.

You need to emphasize that you will suffer serious financial loss/stress and that you have an offer letter or letter from employer stating that you can't continue working unless you get your EAD and that you will lose your income. The letter needs to include your annual income. Have them read the information from the past expedite and tell them it's wrong (if it's wrong). The request need to say you have proof in form of a letter and that you can't continue working. Have them read it back to you before you hang up If they still don't want to re-file, ask to speak to a Tier 2. If that is not successfully, contact your local congressman and tell them your story. File through them and tell them it's URGENT. Include your letter as well.

Thanks rerto. I will try calling them again and see how it goes. I have also booked an appointment at the local CIS office on the 8th. But that's too late, ideally I would like to have this thing expedite well before that.

My status moved to "testing and interview" on 8/26, so just 3 days ago. I know that my local field office (New York City) is always very busy, but I'm still hoping I get my interview date quickly like you did!

Hey rerto, just finished talking to the uscis again. It seems they have put all the right description and this time they said I can't file another one for 5 days after the response. So I am going to call them again on tuesday. By that time I will be out of work so I can tell them that now I am out of work, hopefully that's a good enough financial loss for them to consider by request.

It seems to be up to the agent how long they wait in between requests. Mine said that clearly the last request was not filled out properly - so they filed a new for me right away. You can also request to speak to Tier 2. They may help you where Tier 2 does not.

Either way - make sure of the following next time you file, and make sure the agent reads his notes back to you before you hang up.

1. Make sure you state it will cause financial difficulties/stress to you and your USC spouse.

2. State that you have proof like an offer letter or letter from employer stating that you can't continue working unless you have your EAD. The letter should include the date you are out of work and your annual salary.

3. Make sure they include your phone number and email for notifications, else you will have to wait for a hardcopy letter requesting your proof.

Once all this is in place, call back after two days if you have not heard back yet. Check the status by calling. They might have missed sending out an email or text/call and instead gone the hardcopy route - which will cause delays! You don't want that. If no status update, call back once per day to make sure there's no miss in communication. Be persistent. :)

I learned a lot from my expedite and would do it different if I did it again. Just as I advised above. :)

Hey guys! I mailed my package in July and I did my interview august 20. I got RFE for my pay stubs or w2 at the interview. I'm adjusting from j1. Ugh! My husband and I filed tax jointly so I don't know why she still needed my individual W2. Anyways I mailed it off yesterday to the local office. Hoping to hear from them soon.

hey aks1362, i absolutely agree with what retro said. I would also recommend seeking help from your congressman who may be able to help expedite on your behalf. Have you tried that yet?

Thanks rerto. I am doing all the things you mentioned. Very clearly stating the financial issue along with the fact that I have the employer letter and some examples of problems I will face if I dont get my EAD soon (loan payments, etc). I will be calling them again on tuesday now. If they dont agree I am going to talk to the tier 2 person and see if that helps. If that doesn't work I am thinking of just going straight to their local office and see someone in person.

Thanks sophiesworld ... I just find it hard to believe that they would have any interest in helping me out. But I guess it wont hurt to try. I will trying contacting USCIS one more time and if it doesn't work I will see if I can contact the congressman.

08.03.14 (Day 14) Biometrics appointment set for 08/15

08.11.14 (Day 22) Biometrics walk-in successful

08.21.14 (Day 32) Case moved to 'Testing and Interview'

09.15.14 (Day 57) EAD Card/Document in Production

09.19.14 (Day 61) EAD Card Mailed

09.20.14 (Day 62) EAD Card Received!!!!!

09.22.14 (Day 64) Applied for SSN

09.29.14 (Day 71) SSN received

Timeline

hey guys, just put in another request to get EAD expedited. Made them put in a comment that I have documents which I can send to support my request. Lets hope some sanity prevails this time around.

Its quite weird, its been almost 20 days since my biometrics and almost 2 months since they have my application and so far nothing has changed.
