Hi Guys, need your sincere advice on this issue:

I became US Citizen like 7 months ago through my soon-to-be ex-wife, my USC wife filed for divorce 2 months ago and she already moved out of the house without my knowledge. Guess she got some personally issues, and refused to discuss it with me. Maybe I would find out in the divorce paper. Like it's too soon, though I was married for 7 years and she was the one that filed for divorce.

Now I am trying to file for my new friend with I-129F as my new fiancée, so she can come to USA, she is in Denmark. Is it too early for that in the presence of Immigration? Should I wait little while before I file for my fiancée? I can't wait too long, going to see her this coming month again. What can I do? Help!!!

I need your advice before I begin the process, Just concern and worry.

You can file the I-129F petition as soon as your divorce is final, but not before then. You must be legally free to wed on the day you file the petition, and until your divorce is final, you're not.

Latest news: Green card received 16 April 2007. USCIS-free until 3 January 2009! Eligible to naturalize 3 April 2010.

You need to be legally able to marry thus you need your divorce final (offical papers from the court) before you can legally file a K-1. Good luck

Or (I know the humour is really bad, so don't riposte me) you could wait till some states legalise polygamy (there are activist groups pushing for that) and file from one of those after such law passes.:lol:

Seriously though...

As previously stated you cannot file for a K-1 visa until your Divorce has been finalized because you have to be able to prove that you are legally able to marry your new Fiancee. Until the divorce is finalized and you have a copy of the divorce decree to put in with your application, you will have to sit tight on applying for a K-1 visa.

12/20/2016 - N-400 mailed to Phoenix lockbox

01/17/2017 - NOA Received

01/25/2017 - Attended biometrics in St. Louis

09/29/2017 - Received I-797C notice dated 09/27/17.  Interview Scheduled for November 6th @ 8am

11/06/2017 - N400 interview in St. Louis.  Approved !!:jest:

02/05/2018 - Notice of Oath Ceremony date received.  March 1st, 2018 @ 8.30am

Like others have said, you need to wait until your divorce is final and you have a certified copy of your divorce decree before you can file the I-129f.

Divorce is in final stage and should be competed by March 15th.

My question was, is ok for me to travel to Denmark, after finished the divorce case and see my girl and then file for her after the visitation.

I am going finish divorce before file for I-129F, was it too early or too soon if I file as view by the Immigration?

As long as you're free to marry, I don't think they care. Your fiancee might be asked some questions about your previous marriage at her interview, so she should be prepared to answer them completely and honestly.
