First of all, congrats. a couple of questions if you don't mind....It took 39 days from approval at interview? What is 39 days in AP? your interview was on 6/9th--what happened at the interview?

I can't tell why the consulate officer said denial was for unlawful presence. I would suspect it would be due to unlawful possession of firearm?

Earlier today, I was very happy (and relieved) to learn that my wife and 16 yr old stepson received approval for their immigration visas. It was a stressful 24 hours, as I learned about the Malaysian Airlines tragedy only 30 minutes before they boarded a plane from Stavropol to Moscow, and it looked like the flight path would take them close to the Ukrainian border. They arrived safely in Moscow close to midnight, but then texted me that my wife lost her wallet with her credit cards. Fortunately, they still had their passports and documents for the interview at 8 am. They had enough cash to get to and from the embassy, but spent the night in the airport terminal, and got little sleep.

They arrived early at the embassy, and weren't allowed to check an iPad at security, so instead they paid a guard at a nearby office building to hold it. They were at the embassy for two hours, and talked with three people. One man was interested to know why my wife waited so long to apply for a green card (we met in late 2010), so she explained that we agreed her son would finish school in his hometown. She said they will come to the USA for the rest of the summer, and then return to Russia for his final year of school. I had wondered if that would be a problem, but it wasn't, and the man only said my stepson will need to return to the U.S. again within a year.

So they were told the visas were approved, and original documents we submitted were returned. They were also told the passports would be delivered within a week by the Pony Express mail service. The CEAC site now shows my wife as "AP" and stepson as "issued." We're looking forward to them arriving soon, hopefully by a week from now. Oh yeah, when they arrived back in Stavropol today, they found her wallet was in the car. :)

It's been a long journey since we filed the I-130 on June 10 of last year, and I only wish I'd learned about VJ much earlier in the process!

So will the package for POE be mailed with the passports?

They went through three scares and came out on top (flight, wallet, and stepson's approval). How wonderful! The last one was scarier than you think. They could have easily denied him. To state that the kid will leave the US for a year at the interview was a bit bold and reckless. I definitely wouldn't volunteer that information at the POE. Besides, finishing his last year in the US would probably better prepare him for college in the US. You might want to reconsider that plan.

We were in Administrative processing for 39 days. My hubby had his interview on 06-09 but my income was not enough last year because I was unemployed, I submitted my AOS with my present income information and there no issues at the NVC stage. The consular officer did not like my income even if I was above the poverty line, the officer requested the form I864A from my ex-husband, my ex husband signed it for us and we submitted to the consulate, after waiting for two weeks the consular officer requested another join sponsor. We submitted the documents on Wednesday and the status was changed yesterday to AP and today it changed to Issued

To state that the kid will leave the US for a year at the interview was a bit bold and reckless. I definitely wouldn't volunteer that information at the POE. Besides, finishing his last year in the US would probably better prepare him for college in the US. You might want to reconsider that plan.

Thanks for the advice, but they will be returning here for Christmas, so it will only be a few months out of the country. And from what I've read, having a green card doesn't prevent someone from attending college outside the U.S., as long as they continue to make the U.S. their home with regular visits. So we'll see what he thinks during this trip, which will be his first to the U.S.

So we'll see what he thinks during this trip, which will be his first to the U.S.

I believe this statement is based on someone's experience and not on a proper understanding of the powers vested in CBP officers. Every time a GC holder re-enters the US, regardless of how long the absence, he/she must be ready to show evidence of US domicile if challenged, or risk having his/her GC status cancelled and denied entry. For a student, being registered in a US school/college is the obvious proof.

If the GC holder is absent for more than a year then he/she must present a re-entry permit. It's this last bit that confuses many and leads them to think that showing up within a few months would automatically reset their GC status unchallenged.

Please do not just take my word for it. Consult an immigration lawyer on this matter, and if he/she happens to confirm what you said above, then make sure to get it out of him/her in writing and in proper English. Lawyers can bury a lot of certainties with their gibberish.

They won't deny an IV on a mere suspicion. They have AP for that, and they would still approve the visa eventually if they couldn't find concrete evidence to warrant denial.

I'm sympathetic to those who fit one or more criteria for inadmissibility due to no fault of their own. As for others (especially those with violence-related history)... good riddance, I'd say.

I don't think you do. All originals that the embassy asks for pertain to the beneficiary.

He is a US citizen, lived in the UK, now moved back to the US. I am French, we met in 2010 in the UK and got married in March 2013 in France.
