I think it'll be ok. The VWP is for pleasure and limited business use, info below from the DoS website:

The following are examples of activities permitted while in the United States on the VWP.

  • consult with business associates
  • attend a scientific, educational, professional, or business convention or conference
  • attend short-term training (you may not be paid by any source in the United States with the exception of expenses incidental to your stay)
  • negotiate a contract

I don't think employers can legally hire someone without status (probably not the right words, but you know what I mean). Since the applicant is not yet a permanent resident, they cannot work yet. Is the potential employer aware of this, Eastyo? they would have to hold the position for you for at least a couple months, and from their point of view, there's no guarantees since you're not here legally yet.

I have a question, ,

Does the priority date ,, for the cc make any difference???

My case was cc July 9th , but the priority date is April 2nd ,,,

This for the USA embassy in cairo Egypt. .

For you its not about priority dates its about the availability of your embassy. Right now They are scheduling March Case Completes. It's a 6 to 8 month after Case Complete wait for Egypt. Sorry.

Anyone getting Interview letter in email yet? Why do they take so long good grief. (I act like its me. hehe) :goofy:

One question, I have been to the states a few times during this process with no issue. However i have been offered 3 interviews at the end of August for 3 great roles ... do you think (if i have my interview letter) that if i state this when entering the US it will be an issue?

It's a big risk because you are almost at the end of process but I would at least like you say have interview letter in hand and they know "Oh they just being proactive" and you have return ticket. But see now you have no ties to UK at this point so see the dilemma. They might be thinking "Maybe he will get denied and he is trying to come to US and stay".

I know people think why would people not return for interview I can think many reasons why and many don't if they can get here. So I would try try try to get that interview date changed. I bet they do it. get the Medical done soonest so you can have medical at embassy by the time your petition gets there. And alert them soon as you get medical that you got it its coming and so is your petition.

I thought so, to be honest i was trying to kill 2 birds with one stone as i am going to my wives niece's graduation party in Wisconsin anyway, so, while i am there .......

I still have to return as i need to present my research for my masters to my supervisor (i have a letter) or else i will not get the degree, but i get your point.

Just got off the phone with NVC... and I HAVE THE BEST NEWS EVER!!!!

Interview set for September 11th in Montreal!!!! WOOHOOO!!!!!

IR1/CR1 Visa - We are using a lawyer!

22 Jan 2013 -- packageSent
31 Jan 2013 -- NOA1 from NBC

6 Mar 2013 -- I130 transferred to Orlando local field office (which started the whole nightmare)

Mar 2013 to October 2013 no one would tell us where our case was or what was happening. I suspected the whole time it was just sitting in a corner somewhere in the Orlando field office. I was pretty much right.

October 2013 - get congressman involved. Congressman asks USCIS repeatedly about our case but they won't even tell them anything.

31 Jan 2014- finally get NOA2!!!! (we think the nightmare is over!)

NVC

Our case was not sent from the Orlando field office as it should have been. The nightmare continues. We kept calling NVC and asking if they received our case, and they always said "NO" and that we had to wait 90 business days for it to be received. We called USCIS during this time and they kept telling us it had been sent. After the 90 days of agonizing frustration, NVC then started telling us we had to wait 120 business days. I got our congressman involved again, and they told the congressman it was sitting at the Orlando office this whole time (just as I thought it was!).

22 Apr 2014 -- NVC received
16 May 2014 -- NVC case number assigned
24 May 2014 -- AoS and IV bills paid

28 May 2014 -- Sent AoS and IV Packages

6 June 2014 -- documents scanned

18 July 2014 -- false checklist from NVC

21 July 2014 -- Case complete

28 July 2014 -- receive case complete email from NV

30 July 2014 -- interview booked! September 11 here I come!

As i said, i need to go anyway, I was just trying to be proactive about it...... ugh

Yes, both employers know that I am awaiting this interview and that, as per right now, I do not physically have a visa.However they know that it has been approved up until the final interview stage.

You make a good point about any offer, my wife made the same, but i am not sure.

In the UK, and yes the US may be different, they can offer a job, however it is up to the employee to prove their right to work in the UK on the first day.

Regardless there will probably need to be some level of trust

The only reason i started even looking now (in-fact i was headhunted for one) was that my wife's took 2 months to get from application to final interview, i never thought it would move this quick .... lets hope London can squeeze me in, my medical is on Monday so hopefully they can do something!

Employers should not ask whether or not a job applicant is a United States citizen before making an offer of employment. The Immigration Reform and Control Act of 12986 (IRCA) makes it illegal for employers to discriminate with respect to hiring, firing, or recruitment or referral for a fee, based on an individual's citizenship or immigration status. For example, the law prohibits employers from hiring only U.S. citizens or lawful permanent residents unless required to do so by law, regulation or government contract; it also prohibits employers from preferring to hire temporary visa holders or undocumented workers over qualified U.S. citizens or other protected individuals, such as refugees or individuals granted asylum.

IRCA requires employers to verify the identity and employment eligibility of all employees hired after November 6, 1986, by completing the Employment Eligibility Verification (I-9) Form, and reviewing documents showing the employee's identity and employment authorization. The law prohibits employers from rejecting valid documents or insisting on additional documents beyond what is legally required for employment eligibility verification (or the Department of Homeland Security (DHS) Form I-9), based on an employee's citizenship status or national origin. For example, e.g., an employer cannot require only individuals the employer perceives as "foreign" to verify their employment eligibility or produce specific documents, such as Permanent Resident ("green") cards or Employment Authorization Documents. It is the employee's choice which of the permitted documents to show for employment eligibility verification. As long as the document appears reasonably genuine on its face, and relates to the employee, it should be accepted.

Because of potential claims of illegal discrimination, employment eligibility verification should be conducted after an offer to hire has been made. Applicants may be informed of these requirements in the pre-employment setting by adding the following statement on the employment application:

"In compliance with federal law, all persons hired will be required to verify identity and eligibility to work in the United States and to complete the required employment eligibility verification document form upon hire."

So i guess that an offer can be made subject to this ....

Anyway.... I will hopefully have my interview before this becomes an issue

If an offer is made, this will probably be before your visa interview anyway and you won't be eligible for the job. On most job applications there's a question that asks if you're authorized to work in the United States.

MoBar mentioned a good point a couple posts back. I personally think you're taking a very big risk and rushing for the sake of rushing.
