Hello everyone,

I'm after some clarification on the household sizes I should be filling in for my I-864 Affidavit of Support and my joint sponsors AoS.

I've read several posts on here and other websites in an attempt to clarify my questions, however would like to confirm what I'm thinking prior to submitting my AoS.

My circumstances:

  • I'm the beneficiary
  • My wife (USC) and I live abroad in my home country of Australia
  • My wife's parents (my in-laws) are both USC and live in the States
  • My wife has been unemployed and as such cannot contribute funds for her AoS
  • My mother-in-law will be our joint sponsor, and she can easily meet the 125% of the poverty amount
  • My father-in-law will not be contributing to the AoS as he is retired

My questions:

  1. As my wife and I both live overseas I imagine that the household size on her AoS would be 2: my wife (sponsor), and me (beneficary)?? Her mom wouldn't be on there as although she is a joint sponsor, she does not reside in our house in Australia. Is this correct??
  2. From what I can read on my mother-in-laws AoS, she would have her household size as 3: herself (joint sponsor), me (beneficiary) and her husband (who despite not contributing money towards the AoS, would come under the Spouse box). is my understanding correct??
  3. Finally my understanding is that my wife and her mom will both need to fill in I-864 (and not any other version of this form, eg: I-864EZ, I-864A, etc). Would that be correct??

PS: I would love to see the VJ wiki updated to show some examples or scenarios of household sizes, and what forms should be filled in for different situations.

1. On your wife's AOS, it would be 2 (you and your wife)

2. On your mother-in-law's AOS it would be 3 (the MIL, the FIL, and you- the USC petitioner does not count), UNLESS MIL has more dependents (minor kids, elderly parents she claimed on tax return etc).

3. That is correct.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
