DV(2015) Affidivit Of Support Required

While much of information about DV 2015 is not available as of the availability of the DS-260 form and its submission deadline

Another major regulation that has been confirmed mostly by various embassy and websites state that the new DV(2015) requires the "AFFIDAVIT of SUPPORT" form I-134 to be filled by an IN-STATE sponsor and US Goverment is not willing to make the Diversity Immigrants a liability for much of the embassies (refer to your own embassy)

While the previous forms only required mention and welcome letter this has been a major change starting this year.

Although the following FAQ states that personal assets will also work i heard that much embassies will require Affidavit of Support as mandatory.

Though i am not a DV applicant(one of my closest friend is) i thought maybe there could be a discussion made about this.for the help of all DV applicants. And please share about your country and what your embassy states.

United States, help me find housing and employment, and/or provide healthcare or any subsidies

No. The U.S. government will not provide any of these services to you if you receive a visa through the DV
program. If you are selected to apply for a DV, you will be required to provide evidence that you will not
become a public charge in the United States before being issued a visa. This evidence may be in the form of a
combination of your personal assets, an Affidavit of Support (Form I-134) submitted by a relative or friend
residing in the United States, an offer of employment from an employer in the United States, or other
evidence.

Timeline

The key words here are 'may' and 'or'. It does not state that it is compulsory to have an Affidavit of Support. I think that needs to be clear. Specific embassies / consulates might prefer it but it's not compulsory, in my opinion.

This evidence may be in the form of a combination of your personal assets, an Affidavit of Support (Form I-134) submitted by a relative or friend residing in the United States, an offer of employment from an employer in the United States, or other evidence.

Have you got any links to embassies that explicitly require an Affidavit of Support. It's certainly not the case in Sydney, Australia, as far as I have read.

Very few embassies have it as mandatory. They may ask for one if they are not otherwise convinced you won't be a public charge; in these instances they won't refuse the application, but will put it on AP pending submission of the AOS.

It is mandatory for our embassy here in Trinidad http://travel.state.gov/content/dam/visas/Supplemental/PTS%20-%20Port%20of%20Spain.pdf and the crazy thing is I have to get all my documentation (including the I-134) first,Then email KCC informing them I have all my documentation with the following info:

  • PTS case number
  • DS-260 confirmation number
  • Name of petitioner
  • Name of the principal applicant

Only then the KCC would schedule an interview date. I've been buying and saving USD for last 3 years and will have approx $50,000 USD in savings by the time of my estimated interview in April/May 2015 and it sucks that I can't utilize this to bolster my case instead having to rely on an I-134 from my aunt. I haven't told my parents yet and I was really hoping to keep this quiet until I have an interview date. Now I'll have to make a somewhat awkward phone call to my Aunt in NYC and ask to fill out and send the I-134 with her personal info..

I think we should wait as what you have attached there is quoted for 2014 winners . We should wait until its our turn and then make arrangements especially since you didn't want to alert anyone else that you have won.

I may be wrong but I don't think we have to fill out Ds-230 either.

That's what I thought but it looks like it's also applicable to 2015 DV winners since it makes reference to the DS-260 and the document I linked was last updated May 6, 2014, but I'll still contact the embassy and confirm...

I will ask too but closer to or when i have confirmation of the interview via email because just like you I really didn't want involve anyone else.

I think I would (personally) challenge that BS by mailing in the proof you have plus a printout of the DoS rules on the matter. They are not following the rules as laid down by DoS. Your savings should be acceptable and the rules are very clear that savings should be taken into account.

Whoa, I do not have any relative in the US, and I would feel like ####### asking for such a huge favor out of anybody here that I'm friends with; I barely even ask people to be my emergency contact, let alone my financial backing in case I end up starving on the streets. Honestly, depending on what the consequences are for the sponsor, I'd be weary of sponsoring anyone, and I hate asking people for things I know I'd have second thoughts about.

By the time of the filing, I will have $10k USD in my savings account and a job paying $60+k a year in a very lucrative field. I'd really rather not ask anyone for favors.

But let's assume I can, cause I've been here 7 years and know people here. What about people that are like I was 7 years ago? No relatives in the US, no family friends in the US, nada. Would having a job offer here and money in your savings account, but not knowing anyone mean your dreams don't come true? That sucks.. and they should make it known before you actually submit the lottery application.

P.S. Do you think I can get my employer to do the Affidavit? They're willing to sponsor the H1B, but I haven't started work yet and I haven't told them I won the DV yet either (and am planning to wait a bit on it). Or does it have to be one person?

Honestly, depending on what the consequences are for the sponsor...

Ther are no consequences for the sponsor because the I-134 is not legally binding. It's seems to be more of a proof of trust between the the sponsor and the sponsored person (they have to disclose their assets to you).
