Hello everyone

Me & my wife will begin our last phase of the journey on July 24th of this year. Would there be a problem if she was go to back to her country on the 27th of August and coming back on the 14th of October? Would she still be using the same Green Card since it wouldn`t expire until the 24th of October? What about biometrics?

First, make sure of the date your filing window open. It's not earlier than 90 days before her green card expiration date, NOT 3 months. Use this tool: http://www.uscis.gov/sites/default/files/dateCalculator.html

After sending her ROC package, she will receive a NOA that will basically extend her GC for a year. If she wants to travel, she will have to carry with her that extension letter (original, not photocopy) and her GC, expired or not.

Biometrics should be scheduled to be about 1-2 months after her NOA. She has to do it. If the date is too late and is conflicting with her travel plans, she can try to show up early but there is no guaranties. Some ASC accept early walkin, some do not.

And be careful about fingerprint result. Some people are required to retake biometrics because FBI doesn't accept their fingerprints at first biometrics appointment.

Thanks guys. After trying out the calculator the earliest filing date is July 28th , 2014 therefore I`ll be sure to send it out on the 26th for it to arrive on time. What happens if she can`t make it on her biometrics? Can a biometrics be rescheduled? I have also heard of April filers having their last biometrics from AOS used is this true?

Yes, she can reschedule the appointment.

Some April and May filers got their biometrics appointment waived, but that doesn't seem to be the case anymore. We don't know what happened but June filers are all receiving a letter so the situation is back to normal.

If her appointment date is during her overseas trip:

- try a walk in at the ASC once she gets the letter (they won't accept her without the appointment letter),

- if that doesn't work, reschedule the appointment.

Ok and how can a appointment be rescheduled? Would it be best for her to call or email?

I don't know if you can choose a date though.

Edit: I see in your signature that you did an early walk in for AOS. Have you moved since then? If not, then they may accept you for a walk in again!

If you send on 26th, it'll get rejected.

No. Check out the calendar, July 26th is a Saturday. By the time it gets delivered, it will be the 28th at the earliest.
