I live in Pennsylvania and there is no centralization of divorce records. They can only be obtained from the county the divorce took place. The problem is I lost my original copy of my divorce and cannot remember where I got the divorce in. I'm at a loss because I don't want to lie on the petition for the K1 visa. Would USCIS be able to find out I'm divorced?

Yes, from you being honest on the forms where it asks for that information.

There are only so many counties in a state, you can call one by one until you find the correct one, surely.

Of course they can find out if you have been divorced. Never lie on any immigration form, ever. If you were previously married, you must include a copy of your divorce decree.

Agree 100% about not lying on any official form (that you sign under penalty of perjury, especially). For the K-1 visa, whether you've been married before or not is a key question, since you must document that you are legally free to marry....making it an even higher possibility that it might be checked.

Surely you remember where you were living/working/studying (whatever you were doing) when you got divorced? I would start with the county where the town I was living in was located and then the surrounding ones. Yes, it might take a little extra work, but you don't want to get caught lying about this very important information.

To be eligible for a K-1 visa you have to submit appropriate evidence that all prior marriages have been terminated. The I-129F form instructions give examples of appropriate evidence: http://www.uscis.gov/sites/default/files/files/form/i-129finstr.pdf By signing the Form I-129F petition, you are stating under penalty of perjury that all of the information and documentation submitted with this form is true and and correct.

You're going to need to get a copy of that divorce decree for your paperwork, so start thinking about where you lived. (Actually, you're going to need at least two copies; I got three copies when I had to order my divorce decrees from Washington state.) If you were both living in Bucks, chances are pretty good you didn't get divorced in Allegheny.

I had to hire a Private Detective, cost was around 150 bucks to find out my Ex Wives information for the G325A.

as i recall, the only "ex-wife" information required on the G-325A is her maiden name, date and place of marriage and date and place of termination of marriage.

True, but the I-129F instructions are a bit more explicit in the types of required information. Refer to the Form I-129F instructions for details, see my response #6 for instruction link.

We are going to file for Naturalization citizenship in a few months. I have noticed that Divorce documents for both petitioner and beneficiary are asked for again in the N-400 instructions as well. Try to get them to avoid any future issues in the process. Court Clerks are usually very cooperative to help get them to you for a small fee. Search a county map of the state and start calling them. Unsure if USCIS can find out or not.

Hi A&B...no argument here,i respect your knowledge and the help you provide here but I just want to clarify so I dont give people incorrect information. The I-129_F form also requires name and date of marriage termination with of course supporting evidence(divorce decree) I submitted certified copies with my petition. If you have submitted a previous I-129-F the form requests the A# and a box for "end result" of that previous petition. If you do not have the A# a dated and signed note that you do not know the # and have been unable to contact the beneficiary to acquire it will suffice with U.S.C.I.S. Also, a signed and dated note explaining,for example, that the previous beneficiary is living and working in Indiana and is now a USC will also be accepted by the U.S.C.I.S. If you file a I-129-F while still under the"umbrella" of a previous I-864 is something I know nothing about and cannot comment on...thx and have a great day....stevie

That is correct. If there information about a previous spouse that you do not know, such as their A#, you can put Unknown.

However, you need to know the date and place the marriage was terminated and supply a copy of the divorce decree. It is a main requirement of the I-129F that you both be free to marry. Proving all prior marriages were terminated is part of that requirement.

there is a topic in AOS section where a Nigerian woman states that at her AOS interview she was informed that her husband had been married 2 times AND 2 previous U.S.C.I.S. petitions had been filed by him and they are requiring the divorce decrees....I don't understand how this petition made it so far.

Well,first of all it have nothing to do with question asked here.Of cuz they found abt him bc he applied for AOS 2 times before.and if that nigerian woman didnt know abt ,its not her fault and its not suppose to affect her.
