I have children from my previous relationship...

Their father was an american and we have no contact since 2011...

I met my american fiance and were currently on the process for k1 derivative k2 visa...

I just wondering if we arrived there in USA and granted for conditional resident...

It is posible to file for child support to their father?

Their father has a stable business and i have proof that he has good income...

He signed my daughter birth certificate but not for my son as weve separated before he was born...

I tried to contact him before and ask for child support but he just ignored me and never help us since 2011...

I did not want my fiance to adopt my kids...

It is posible that we can ask for child support?

Once the children are in the US you would go to your local child support office to apply for child support. After filing out some forms they will do the rest and inform you when you need to appear with the children for DNA testing, court, etc.

Do keep in mind that the minute paternity is established he gains parental rights to the children and can do anything from completely ignoring them to filing for custody of them. Family court can be very ugly and very expensive. If he wants to file for custody expect to spend at least $5,000 fighting him in court.

Hi,

You can go after the father for child support.

Before you do that, you might want to consider what can happen when you ask the court for him to step up as the father. It means he gets all the rights of being a parent. He can ask for custody.

So what should i do then?

I am willing to introduce my kids to him as their father, even their father and I were not in good terms i dont teach my kids to hate him... I even should his picture to them...

If i want to get child support, do i have to hire a lawyer?

What is my chances if ever i will file a case,

My ex fiance is married now and had also a baby with his new wife.

I am not doin it coz i was mad at him but for my children sake...

He only helped me with the hospital bills when i had my son... Then after that he doesnt wanna help anymore.. I raise my kids with my own for the past few years. And I am a good mom to my kids although i dont have a job right now...

He got a successful business... I am not asking him alot of money for support just for reasonable amount but this american hated me coz of false story he heard...

We have two kids together, if he will file a custody children and minor. They should immediately goes with the mother right?

Im also concern coz he threatend me before that if ever i file child support. He will make me suffer by filing child custody. And he doesnt care either he ein or lose as long as i also spend money.

So my question is there any lawyer who represent those people who dont have money to hire for a private lawyer?

I read an article related with child support and child custody...it stated there children at minor age mostly given to the mother... Its been 3years he did not support, and dont even see his kids for the past 3days... Mother has big chances of getting the mother custody...

There is no guarantee that the mother will receive custody if there is a custody battle, and children should and are not immediately given to the mother for custody. That used to be the case, but courts have changed significantly in the last two decades. West Coast courts also have a reputation of being much more equitable and much more likely to consider the entire picture: finances, stability, relationships, ability to support, etc.
