A Quick question FOR IR2-STEP DAUGHTER petition..soon to have her interview!!

My foreign husband petition my 5yrs old daughter. She`ll have her interview soon on august 5th. Is there any possibility she gets denied? My daughter is illigetimate, her birth certificate has no signature of her biological father and i was not married with him. He left us when i was 6months pregnant with my daughter. I wonder if the consul will ask for adoption papers or a consent from my daughters biological father???i no longer know his whereabouts, no communication. And What do i need to bring during my daughters interview at usem?? What are their questions? Is it okay if me and my husband will accomany her during the interview?

You both will be able to attend the interview, as my wife and I just did last week with my stepdaughter. We are in the same situation, USC stepfather petitioning an IR2, no bio father listed on the birth certificate, and no communication with him either. No problems for us at the interview, the consul seemed more concerned with confirming the validity of our marriage. She only asked our daughter to verify her name and birthdate. The consul had also asked my wife when she had entered the US; she hasn't yet because she just received her visa last month and we were waiting for her daughter's to be approved this month. She accepted that response. Just those few questions in the five minute interview. Approved and issued quickly, we are now just waiting for the visa to be released to 2go.

One thing though is that I have been raising my stepdaughter for over 8 years, and that may have been influenced the consul's decision to our benefit.

Thank you so much for the reply!! My husband and i have been together for more than 3yrs now. We got married when my daughter's still 1yr old.. My daughter grow up knowing that her "daddy" is him.. My husband petitioned me and my daughter together IR1/IR2 visa category but i got approved first last year june 2013.., now its my daughter's turn and we are hoping and praying that she'll get her visa approved and that there will be no problems on her medical..

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

No worries, you'll be fine. You don't need anything from the bio father. As the mother of an illegitimate child, sole custody is yours. USEM will only verify your daughter's details and of course they want to see her personally.
