Hi,

I'm hoping someone who has adjusted their status might be able to help!

I was arrested around 5-6 years ago. I took a taxi, went inside to get cash to pay, fell asleep (It was my birthday, so was pretty intoxicated). The police came, arrested me. I spend the night in a cell as I wasn't able to give a statement whilst drunk. Woke the next morning, gave my statement, the cops laughed a lot - I offered to pay the taxi, which I did, was released, with no charges.

So, when adjusting, I applied for a copy of my record - Which was sent out to me around a month later. This clearly shows the arrest (A part of me was hoping it wouldn't).

My question now is this - The document is pretty confusing, but I'm pretty sure it doesn't show that absolutely no charges were raised, that I never had to attend court or anything happened after that night. Ideally I would like a document to show this, to show that I didn't intentionally commit a crime, and that no charges occurred etc.

Does anyone know, specifically in the UK, how I could go about getting a document like this? Also, I no longer live in the UK, so I need to be able to get it out in the states, as soon as possible really.

Any help is much appreciated!

I can't speak specifically to the UK, but here in the U.S. many police departments will give a person a letter of being "detained" in situations like you describe. My brother had a similar incident as yours, and received such a letter. Essentially it says you were never technically arrested, although I'm sure it certainly felt like it to you. Might be something you could try with the police in the UK.

I have heard of those getting visas discussing Subject Access Report and Memorandum of Conviction. That might give you some key words to search on. Here's the ACRO website with some info on records other than the basic ACPO police report. http://www.acro.police.uk/subject_access.aspx

There are links to local police departments down that same page for further records. An email to ACRO would probably answer your question on how to get the record you require if you explain what you need beyond what you have.

From what I remember, ACRO is where I originally got the arrest history that I currently have copies of, but they didn't provide any further information. I will have to delve deeper on that website and try to find the local station and see if they can provide a further record!

So after a few emails back and forth I can actually say ACRO have a great customer service section. all my emails have been replied to straight away, and with all the information I need.

Apparently the document I have currently is a Subject Access. This is for personal use, and isn't much use in a immigration setting.

I need to apply for a police certificate. Hopefully this won't take too much time to get to me! According to the girl I have been emailing, if no further action was taking after the arrest, nothing at all should show on my police certificate, which would be nice - and is something less to have to explain to USCIS.
