Hi all, after 3 years of marriage, few days ago we realized that I am pragnant and should expect a baby in 7 month. My husband is visiting me in the US now and I am a US citizen. Can my husband stay in US as he has his flight booked back in 3 weeks? He is from Holland and can stay 90 days at the time. Thanks

Thank you for all your replies and help. Much appreciated. We came back from Holland exactly 40 days ago. I guess if he changes his flight just in case so he can stay another 50 days to see if he get permission to stay permanently. Would he be legally allowed to stay over 90 days if we fill in the paper works? Thanks

After you file for his adjustment of status, he will be in a period of authorized stay until the case gets processed. Even if this period extends over 90 days, he's fine as long as the paperwork has been filed and received by USCIS.

Thanks you all for the advise and links again. I was looking at the Forms which was advised by Ontarkie (thanks) and on i-485 form on Part 2 (application Type) I don't see any option which can suit my husband. Although the instroction says I have to use this form. Does anyone know which option should be ticked?

In Part 2 of I485; Should I choose option "H. Other Basis of eligibility?" and explain that he is from Holland and didn't need a Visa? Thanks

It is valid to say that after you file the Adjustment of Status, it may take in between 60 - 90 days until he gets the permission to leave the country (advance parole). You are gonna have to file the i-131 too.

Thanks Harpa :) I just undertoood that I-130 is for petition and If I choose Part 2 A. then concurrent filing makes sence. Great! Do you know I should put his address in Holland on all these forms or my (our) current address in San Diego where I am sure won't change the entire time through the process, although he still has an address in Holland but he will be living in my address. Thanks!

You put your US address of residence for all forms.

You'll have to put Holland in the last address abroad question.

He also needs to get a medical exam done by a designated doctor called a Civil Surgeon (CS). The CS will put the results on form I-693 and then put it in a sealed envelope, and you send that in with your package. Your husband could start calling around for quotes (try to find one around $200). There is a Civil Surgeon locator at uscis.gov

Great! :) I will follow your help regarding the address. Also just got off the phone and booked a test for Monday in an authorized Civil Surgeon near us. She said it will cost $140 for Physical test and if my husband can't show any immunization records then it will cost around an additional $500 for the vaccination!! I wonder what vaccination he might need without any records. Is that a fare price? Thanks

Hi,

I am in Riverside, CA and recently paid $450 for full medical and vaccinations. I checked with 5 Civil Surgeons in my area and they all quoted the same. You do need this if you can not provide a vaccination record. My GP in UK provided my medical history but had no paper record on file of certain vaccinations. MMR, Hep B and C, (3 vaccinations) TB swatch (return 72 hours later) and syphilis all included with full bloods. It is a requirement of the I-485 and needs to be signed and sealed by the Civil Surgeon and sent with your AOS application.
