OP, you're not being judged, you're being advised. If anyone said something that might've come out the wrong way, sorry about that. If you can't go visit him, I would then suggest him visiting you. Now, if that's not an option, idk what else could be done, maybe someone else will have a more appropiate answer for you.

If you son is autistic, maybe he can travel with you.

Travel make good to people.

I advise you that because apply for a fiance visa without meet in person is a bad idea.

Uscis care when usc doesnt cant travel.

But if you want waste your money you can apply, usa governement will be happy with your money.

They will deny you and take your money.

You can apply a million of times without the requirement they dont care, they take money and deny.

You need meet in person first.

Easy now. Don't get offended - nobody here is attacking you. USCIS is the one that will be judging you, and they do so based on hard rules, facts, and statements you give. People here are just trying to point out where you might fail the requirements.

USCIS does not care. What they DO want to know: WERE you married before ("YES"), and IS THAT OVER NOW ("YES"). They don't want to see proof of being married before, they want to see proof of the marriage being completely over (by divorce or death), so you in your case you will need a decree either documenting the divorce (if you divorced him BEFORE he died), or one documenting his death (if you separated, but stayed married to him, making you a widow. So, please explain "we got separated" - did you DIVORCE or not?

That was actually a very nice thing you did. But, again, it's not on the USCIS list of "why we approve applicants". We must establish whether or not you officially divorced from that person (in which case you must have a Divorce Decree from the court), or if his death made you a widow, meaning you have a death certificate to prove that. Those two will establish that you are "free to marry" your new fiance.

That is good. Since you are the U.S. Citizen filing the petition on behalf of your fiance, you WILL have to prove (to USCIS, not us..) that you will be able to take care of him, financially. You also have to take care of yourself, your children, and anyone else in your household, so in the paperwork you file, you must include ALL of the people in that household (including yourself and the fiance), and then list your (verifyable !) income and/or assets. If "just" your job income is not 100 to 125% of the poverty guideline for your household, you probably should disclose the bank account information as well. If that still is not enough, you MAY have to find a co-sponsor before this can be filed.

He will know, soon. He will get a copy of all information you provide (including the "sponsor" financial information, and/or criminal records, and so on) during his consulate/embassy interview. So, even there, you probably want to discuss this with him, so it will not come as a surprise when he gets the file later on...

Although I see the problem here, I seriously doubt USCIS will consider this "extreme hardship" on your part, sorry.

So... we have:

1. Make sure you have a divorce decree or husband's death certificate, proving that you pass the "free to marry" requirement.

2. Make sure you have met your fiance in person before you file. This may be a hard thing to do, but, sadly, it is a very strict requirement, and you WILL be denied if this has not happened. You can visit him, or he can visit you, doesn't matter. It has to be done!

3. Make sure your financial situation is acceptable to pass the "sponsorship" requirement. Your household size is you, ALL your (dependent, so, under-18) children, any other dependent family members, and your fiance.

My old professor once said "Uhm... yes. The quality of the question, my dear friend, determines the quality of the answer(s) you will get!", and he was right. People here are or have been in the same situation (namely, applying for a visa) and so they will only try to point out the pitfalls they encountered.

See it this way.... it's better we tell you things, rather than the USCIS officer...

Have faith, take your time, and get all info together. Then, report back here, and ask more questions!

Waivers for the meeting in person requirement are rarely approved, so you need to know that up front, before filing. People here were trying to let you know that.

All you can do is include your request for a waiver of the meeting in person requirement when you file. Provide proof of why you cannot travel and meet each other, even in a third-party country somewhere closer to you. If they approve it, then great. If they deny it, then you will need to find a way to meet in person and then re-file your petition.
