You have to marry in a country that allows same sex marriage, and then you can petition him as a Greencard holder. It takes a few years, give or take.

If he cannot get to a country with same sex marriage, you could wait until you are a citizen and then petition him as a fiance.

Can he apply for a tourist visa goin here and then we can marry here in the US and let him go back to the philippines and start my petition to him?

How about going to Canada and marry him there? how can we get a tourist visa in canada?

Getting married in the US on a tourist visa is NOT fraud, Marco.

Yes, if he can get a tourist visa you guys can marry here and then he has to go back and wait for a visa number to be current (a few years right now, could change to less).

He could try Canada. Any country where you guys can get married is fine.

Tourist visas are given by the embassy of the country in his country, so the US embassy in PI, or the Canadian embassy in PI, would be the place to apply for a tourist visa.

By the way, if he apply for a us tourist visa, if during the interview, the consul ask him what is his purpose in getting a tourist visa? Is it ok that he can tell the truth that he will just visit me or we have to think another reason to avoid visa denial? What do you think.

You should just tell the truth that he is visiting you. It's okay.

If he is denied, it won't have an impact on the family visa (unless he is denied for lying or something).
