Does K1 visa approved petition expires?

Hi friends, its been a while. I have a question about K1 visa petition, does it expires? My cousin's K1 visa petition was approved last December and got her Eligibility letter for visa interview dated January, but to date, they haven't done anything about it. Her fiancé keeps making excuses to send her the financial paperwork, and she haven't completed her requirements either waiting for her fiancé. So they haven't scheduled an interview yet for the last 6 months because they are both not ready. We suspect that the guy doesn't really want her here in US so he keeps making excuses of how costly it takes while bragging how much cash he was able to save in the last months. Do any of you know a case where the petition was redirected or cancelled for no action taken? thanks for any info.

Yes, it expires. The letter should have an expiration date on it.

thank you, I went back to my papers before and it does says the validity period. so what happens when it expires? do they have to re-file the petition if they want to?

thank you, I went back to my papers before and it does says the validity period. so what happens when it expires? do they have to re-file the petition if they want to?

yes they'll need to refile the petition if they still want it, if they let it expire.

The petition expires in a year. Initially the NOA2 will show a 4 month validity, after that the embassy will automatically extend the validity up to a year. After that it is a DO OVER.

I'm aware of one couple that kept the K-1 petition alive for two years at the Manila Embassy. They were going to have issues with a qualifying income due to a layoff, and it took that long to get back to work and dig out of the hole again. But they stayed in contact with the embassy to keep the petition alive.

I'm aware of one couple that kept the K-1 petition alive for two years at the Manila Embassy. They were going to have issues with a qualifying income due to a layoff, and it took that long to get back to work and dig out of the hole again. But they stayed in contact with the embassy to keep the petition alive.

Odds are they did the interview near the end of year one, got a denial, after that they have a year to correct deficiencies, so I can believe they dragged it out two years.

That could be. I no longer can find the PM, so don't have the exact details any longer. I just remember they originally filed the I-129f back when we did in early 2011, and she finally got the visa this year.

they have not called in the USEM to set an appointment to date, the validity of their NOA2 expired last April 18, 2014. they are no where ready for a visa interview as they have not worked on their visa requirements. I know, the consulate would extend it if they have been in touch with them before it expires or at least set an appointment and they can always move it when they are not yet ready with their documents, but sadly, their is no problem income wise with this guy, he is just making all kinds of excuses delaying the process, that is why it took so long that they let the petition to expire. I don't see so many couple away from each other working on fiancé visa that would not work on their papers right away. Some were so ready for an interview the moment they get their eligibility. Maybe they just don't miss each other that much and eager to be together, I don't know. I am just trying to get some advice for them.

If they're not ready to commit and go through with the process, why even bother filing again? It sounds like they're happy being BF and GF from 7000 miles apart.

On a side note, does your cousin still want to marry somebody not excited to marry her? Or so it seems, unless there are other factors like financial or family issues?

there is no other factors, both side of the family have been supportive and financial is not an issue. It is the guy who cannot make up his mind to commit. he even wanted to back out of the trip to the Philippines to see my cousin but he keeps saying he likes her, he is such a cheapskate and doesn't want to spend money for everything. he is not sure if he wants to get married either, he is afraid of sharing his money. and would try to scape if he can on a commitment. on the other hand, I think my cousin just love the idea of getting here in US.

This sounds like a case ripe for failure. One is being pushed and doesn't want to, the other just wants to get to the USA. There is nothing right with this couple at all. In fact, if I were you, I would just discourage the cousin to stop pushing the boyfriend. The NOA2 has a clear validity date and with the guy not initiating anything during that period is telling, or maybe he just got cold feet or whatever. It doesn't matter if he knew or his lawyer was telling him the petition is still valid up to 1 year, the point is he let that slipped. So he's probably no longer THAT serious with her.

Let them sort this between themselves. If the guy still wants your cousin to be in US with him, then they will have to contact USEM nonetheless and inquire if they can still pursue the K1 visa based from that approved I-129f petition. If declined, then back to square 1.
