Advice Needed......I'm supposed to be happy....right???

Greetings fellow VJ'ers - I am fairly new to the forum so I hope I am entering this post in the right section. I just found out that I am pregnant (Yeah?!?!?) Well I have been waiting for this day to come for a long time and I want to get super excited however my husband and I only recently submitted the I-30 and are currently in "RFE response review" Based on the way the timelines seem to b progressing, I don't think that he will be here in time for part of the pregnancy or even the birth which is extremely difficult for me since I live alone and all of my family lives out of state (so no help). My question is can we now try and file for the K3 visa? Is that allowed and if so will this expedite a visa so that he can at least come and visit several times during my pregnancy?

Pregnancy is generally not accepted by the USCIS as a valid reason to expedite your immigration case.

If it were, there likely would be a lot more pregnancies.

Thanks for the response A&B. I definitely know that pregnancies are not considered a priority for the USCIS and are not used for expediting the process. I guess I'm confused on what the k3 visa is. I thought it was issued to spouses so that they can come to the US to "wait out" the I-30 process. Is that not the case? I read somewhere that K3's may enable the Visa applicant to enter the US and reside as a "non-immigrant" until the visa petition is approved. Does anyone have any insight on the K3?

K3 is dead, goes back to when a I 130 took a long time.

I inquired about the K-3 or another name for it is I-129F...it is not dead! What is its intended use? I was told by a USCIS rep that its purpose is to expedite your spouse to the USA. So if you file a I-129F after you have filed a I-130 it now becomes a K-3. Now I thought of filling for it but I have not been so convinced that it speeds up anything. If it does get approved it gets merged with your I-129F {in a sense}, but in actuality it cancels the I-130 and then you must follow the path of a I-129 "fiance/ee'" petition. Hope that make a little sense, but again I have not seen where people are moving any faster. Another thought I had is..if they are telling people this how many will jump on it and file now backlogging this process? Also you loose all the benefits {so to speak}, of the I-130. So when your spouse enters the US and have to AOS and then wait and apply for green card and AP status. You decide what is best!

It used to be a USC waited years for the I130 process and the K3 was used to bring them over in about a year. Now either take about the same time and the CR1 is cheaper and the immigrant can work right away

This will not be over quickly. You will not enjoy this.

I have heard that the immigrate cannot work right away they have to wait until their green card and SSN arrive {1-3 months} is that true? There are so many different versions that people are saying out there.

There are different versions because there are different visas.

The ability to legally work depends on the visa type.

A K-1 fiancee visa holder can only work with an EAD or green card. This usually happens months after arriving in the US because the K-1 is a non-immigrant visa requires AOS and waiting for the EAD or green card.

A CR-1 spousal visa holder can work immediately upon entering the US. The CR-1 automatically becomes a green card upon entry.

When a CR1 enters the USA, their visa is endorsed at the POE. That endorsed visa is a temporary green card for up to 1 year. You could go to the SSA office the next day and apply for an SSN but most choose to wait 2-3 weeks in case it comes by itself.

So a CR1 can work and travel right away.

A K1 must apply to adjust their status after marriage. It takes about 90 days to get the EAD which is the work authorization. It takes even longer to get the green card.

That's what I thought. But I have spoken to 3 wives and they all told me that their husbands could not work until they received their hard copy green card. Sorry if I was not specific, all 3 petitions were CR-1. I told them that the stamp in their passport was to serve as their endorsement but 2 out of 3 ladies said no! the 3rd was not sure. Their reasoning was that employers want the hard copy green card that should arrive within weeks after entry. They all went on to give a scenario that if their husbands were at work and immigration showed up their husbands could be detained and the employer would be in big trouble for employing the immigrant without the hard copy. After I heard this I became discouraged, because I read that the immigrate could work the very day after arrival. Was I given wrong info and if so, any proof?

You know when I told a USCIS rep that the K-3 is dead do you know what she told me? She said if it was, why would we be telling people about it, and whoever told you that don't know what they are talking about. We are USCIS not them....stop listening to people!
