Hi everyone,

Me and my wife meet online January 2012 and after 6 month of talking on Skype and getting to know each other, she and her then 7 years old daughter came to visit me in the UK in June 2012. I loved the time I had with them and we got married in the UK on July 2012 and she returned back to USA with my step-daughter. She is from San Diego, California. Although she is always telling me that she is ready to come and live with me in the UK if I prefer but I prefer living in the US.

I have visited her in US 4-times already after our marriage in the UK.

1st: Christmas 2013 (for 14 days)

2nd: Summer 2013 (for 89 days)

3rd: Christmas 2014 (for 30 days)

4st: Summer 2014 (Now as I am writing this post and intending to stay for 89 days)

After so many visits to USA and spending time with my family, especially my step daughter who just turned 9 years a few days ago, it is hard for us to think that I have to go back to the UK again. The life without my family is meaningless in the UK and it’s been hard being separated from them all past times.

We have done some research on VisaJourney and USCIS and it seems it is possible for me to file for Adjustment of Status after entering with VW. Although my intention is/was not to stay in US and I must return back to UK but I think this time I am going to let behind my life in the UK and file for AOS.

We will decide in the next few days for sure but I will use this site for help and appreciate replies from all of the members who share their experience and expertise.

the fact that you are knowingly entering WITH an intention of staying is "technically" against the law.

but the customs don't have a mind reader, so i guess you are free to do whatever.

prepare yourself for a lot of people on here, blaming "people like you" that their process is taking forever since there taking the "honest" path.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I think you got it wrong thinking that I am in the UK still. I am already in the US and last month when I entered did not enter with the intention of staying. This is something we are thinking about to do. That's why I am here to get help.

Is your wife prepared to move to the UK with you if your AOS is denied?

I suggest you consult with an experienced immigration attorney.

Bunnygirl,

It's highly unlikely his AoS will be denied. His case is not complicated. Unless they can prove that he entered with an intention to immigrate, he won't have any trouble.
