Hi everyone- I am in need of help. My husband and i just received our interview date for the final processing of his visa (CR-1) in jauarez Mexico. We were waiting for 13 months and then in Oct. He got tired of waiting and crossed illegal. He has now been living with our son and I for the pass three months. Now we have to go back to Mexico for his interview and we are planning on being honest and letting them know that he was here illegaly...will we be punished because I have collected every piece of evdence they have require to show we have a marriage and I really can't stand the thought of him not being able to return to the US with us. They have to know that basically everyone comes to US illegal and I know it is wrong but he wanted to be with us. I heard something about a 10 yr. ban does this apply to us and what can I do to fix it? Or should we just not go to the interview in fear that he will not be granted a visa? please help and soon our meeting is Jan. 31, 2007

you should see an attorney. There IS a 10 year punishment for anyone who's been in the country illegally for more than 180 days. Maybe you'd be better off not even admitting that he's been here :S

Thanks I knew about then 10 year punishment..but he hasn't been here for 180 days yet...I'm so worried but i have to find out what to do and soon! We live in a week for Mexico

Then there is a three-year ban -- I don't know exactly triggers it but maybe you are at risk -- find and consult with a good immigration attorney.

1-18-2006 She returns to Russia, engaged but not married

6-25-2007 Both NOA2s in hand; notice date 6-15-2007
9-17-2007 K3 visa in hand
11-12-2007 POE Atlanta

8-14-2008 AOS packet sent
9-13-2008 biometrics
1-30-2009 AOS interview
2-12-2009 10-yr Green Card arrives in mail

2-11-2014 US Citizenship ceremony

I don't know the US rules for Mexican citizens to cross the border. But at 1st sight, inform with a lawyer if: was he illegal or not, due to the fact that his visa was pending which is different. But again, i speak generally...as for those who cross the border during the time their visa papers are pending...You can have advice from lawyers for a little amount of money....Good luck!

25 Aug 06 - Sent I-130 (a Friday)

28 Aug 06 - NOA1 & Certif. receipt returned ( a Monday) Day 1

29 Aug 06 - USCIS cashes check

30 Aug 06 - check cleared & 1ST TOUCH.

01 Sept 06 - NOA1 recvd by Mail

09 Sept 06 - 2ND TOUCH (a Saturday)

09 Mai 07 - NOA2 (2 e-mails)

Note: were told the long delay due to huge backlog and internal changes in VT

NVC :

04-June-07 - NVC generates DS-3032 & AOS bill

12-June-07 - AOS Bill payment sent/ alien receives DS-3032 form (by mail, dated 4th June)

13-June-07 - Alien sends back completed DS-3032 (by mail)/ rcvd 19th of June approx.

To mid July-07 - I-864 form sent completed and IV fee bill

19-July-07 NVC rcv I-864 form; mail signature rcvd.

22-Aug-07 Ds-230 with documents sent to NVC.

20-Sep - 07 Alien sends NVC Missing document. NVC receives it the 25th.

05-Oct - 07 NVC completed.

16-Jan - 08 Interview, 3 questions asked, visa approved same day, received 1week later approx.

Note: delay due to internal delay, missing document (not rfe) and self procrastination of understanding some abstract terms. C Post not at all reliable (delivery duration, delivery with signature (did not deliver personnaly), and delivery of interview letter rcvd after the interview).

In USA:

01-03-08 POE Entry in USA

...-03-08 2 Welcome in America letters and green card received.

"What I know is that I know nothing"
