conversion to L2 during AOS

I am on L1 visa, expiry date:24-Jul-2014. L1 extension is filed by my employer and i recieved an RFE and I have responded to the RFE.

Meanwhile, my GC is being processed under EB1. I have filed the application for AOS along with i-765 (EAD) and am waiting for EAD. Question: what is the best way to continue to stay employed after L1 visa expiry? I plan to convert to L2 (my husband's employer plans to file that ) after L1 expiry, so that I dont have to leave the country if my AOS runs into issues. But my employer says that as L1 RFE is under process and if they dont reply backto before my current L1 visa expires, then i can continue to work for 240 days. if I switch to L2 and my EAD doesnt come before my L1 visa expires, i will be ineligible towork. what isthe best approch to stay employed after 24-Jul?

You will likely need to leave your job on 24th July until you receive your AoS-based EAD. Working illegally might jeopardise your chance of receiving a green card.

EAD from L2 will take 2 to 3 months.
