Filing N-400 With a Minor... Need help before I send it off

I have prepared my entire package. I am aware that my 10 year old son is filing under me and does not need a sep app, nor will I need to file a biometrics fee for him. I have a draft for the filing fee and only bio fee for me.

My question is this... It asks for me to send 2x passport style photos with my app. I have done so for myself. Even though my son is a minor and not doing bio, do they also need 2 passport style photos for him? I just wasn't sure.

Your help is much appreciated! :)

You are not filing with a minor. He is not involved. Once you get citizenship, then he can claim derivative citizenship based on your docs, but until then he has nothing to do with the process. Good luck.

So here's the deal... you're doing everything right, so don't worry, but I want to correct a couple of misconceptions.

Your 10 year old is not filing under you... the N400 is for one applicant only (you). Your son is under 18 and is not eligible to apply for naturalization through the N400 process.

However, on the day that you take your oath of citizenship and become an American, your son will automatically become a US citizen as long as he is still under 18 and is a legal permanent resident.

So there's no need to send in photos of your son because he is not part of the application (except for being listed as a family member).

Once you become a citizen, you can take his birth certificate and your naturalization certificate and apply for a US passport for him.

If you like, you can file an N600 for him (also after you become a citizen) so that he can get a Certificate of Citizenship. This is good to have as it is an additional proof of citizenship, but is not necessary to get a passport.

So, send in your application and once you're done with the process, you can get your son's paperwork taken care of. Good luck!
