Adjustment of status: copy of visa

Hi,

My fiance entered the US with the K-1 visa last week. We are looking into the next steps of applying for his adjustment of status after our marriage and it says we need a copy of his visa. However the immigration officer at the POE in Chicago took the K-1 Visa out of his passport as he said it can only be used once. HELP!

? The K1 visa is like a stamp stick to a page in the passport.

How did the immigration officer remove that from the passport? tear off the passport page?

There should be a passport stamp on a page in the passport that has the K-1 visa on it. The visa is attached right to the page of the passport and the stamp on top of it will show a date 90 days in the future which is the time the K-1 entry is good for. If anyone tore a page out of a passport, that is actually considered illegal by virtually every country in the world, including the US. It invalidates the passport and means that the passport now needs to be replaced by the official issuing country.

If that is indeed what happened, you and your fiance need to go back to the POE as soon as possible and ask to speak with the immigration officer in charge, telling him/her what happened, and geting documentation from them that they removed the K-1 visa from the passport. All visas are supposed to remain in a passport even if they are only good for one entry. They also need to make this good for you because you do need proof of the K-1 entry to continue the next step in the Immigration process.

Good luck to you. I hope that upon checking you will find that the K-1 visa is still attached and something else - although I have no idea what it would be - was removed instead. Still, no pages should be removed from any passport by anyone, ever.

If they really did take out your K-1 visa, that CBP officer had no clue of proper procedures. Kathryn gave you good advice above. You should go to your nearest deferred inspection site and let them know what happened.
